Wie entscheiden Richter, wenn ihnen das Gesetz Freiräume lässt? Die Antwort ist einfach: Sie entscheiden wie jeder andere Mensch auch, der vor der Frage nach der Richtigkeit einer zu treffenden Entscheidung steht. Sie können ihre Entscheidung an den Folgen, die mit ihrer Entscheidung verbunden sind, ausrichten, mithin teleologisch entscheiden, oder sie können ihre Entscheidung an grundlegenden, von den Folgen unabhängigen Regeln orientieren, mithin deontologisch entscheiden. Gleich welchen Systems sie sich auch bedienen mögen, allein die Methodik, nach der sie ihre Entscheidung fällen, hat Einfluss auf die Stellung des Einzelnen in einer Rechtsgemeinschaft. Die Richtigkeit dieser These belegt Morten Göke anhand der Rechtsprechungs- und Auslegungspraxis des EuGH. Er zeigt zugleich, dass für eine politische Union, wie sie die Europäische Union sein möchte, schon aus Gründen der Rechtsstaatlichkeit eine Rechtsprechungs- und Auslegungspraxis geschuldet ist, die Teleologie und Deontologie als gleichsam unverzichtbare Direktiven richterlichen Entscheidens anerkennt.

Die Grundrechtsprufung des Europaischen Gerichtshofs war vor der Rechtsverbindlichkeit der Charta der Grundrechte der Europaischen Union Gegenstand massiver Kritik. Zehn Jahre nach deren Inkrafttreten legt Christian G. H. Riedel die erste umfassende Bestandsaufnahme zur Charta-Rechtsprechung des EuGH vor. Dabei vereint er dogmatisches Arbeiten mit innovativen Methoden zur Rechtsprechungsanalyse: Im ersten Teil kategorisiert er samtliche Entscheidungen des Gerichtshofs, in denen dieser die Charta zitiert. English summary: The European Union finds itself in a democratic crisis. Not only during the course of the financial and state-debt crises has the idea surfaced in public awareness that the economic integration of Europe has become rather political as the response to the question of a European public sphere, a democratic necessity, becomes more urgent. But how does a European public come into being? Within the governmental and administrative networks of the European Union, such a public cannot be developed on the basis of national identity alone. Also, medial constructions of public find functional boundaries within the linguistic, cultural and political complexity of Europe. Within this context, this book undertakes the attempt to deduce a European public from the basic status of the members of associated countries: the union-citizenship of Article 20 of the Treaty on the Functioning of the European Union. In the space of dual legitimation of the European principle of democracy, the individuals as citizens of state and union have developed into a new public space of politics beyond domestic markets and between national parliaments and the European Parliament.
