Der Föderalismus hat im europäischen Integrationsprozeß zunehmend an Bedeutung gewonnen, steht aber heute vor einem neuen Legitimationsdruck. Er verbindet die einzelnen Nationalstaaten zu einer höheren Einheit und sichert ihnen zugleich Vielfalt, Eigenständigkeit und Freiheit. In der vorliegenden Arbeit untersucht die Autorin unter vielfältigem Rekurs auf die deutsche Verfassungsgeschichte den Föderalismus als Prinzip überstaatlicher Gemeinschaftsbildung, die Notwendigkeit der Integration, den Maastrichter Vertrag und die gegenwärtige Verfassungsstruktur der EU. Ihre staatlichen und nichtstaatlichen Elemente machen deutlich, daß die EU in das klassische völkerrechtliche System nicht einzuordnen ist. Auch ist ihr Demokratiedefizit strukturell bedingt. Daraus ergeben sich gemeinschaftsrechtliche, verfassungsrechtliche und politische Grenzen und Perspektiven einer Fortentwicklung der europäischen Föderation, die auf stabilen Nationalstaaten basieren muß. Besondere Beachtung findet die Überlagerung der beiden Föderalismusstrukturen der EU einerseits und des deutschen Bundesstaates andererseits. Die deutschen Bundesländer haben im europäischen Integrationsprozeß eine Aufwertung erfahren; Art. 23 GG hat einen tiefgreifenden Wandel des innerstaatlichen Verfassungsgefüges und des nationalen Föderalismus hervorgerufen und interessante Parallelen zur deutschen Verfassungsgeschichte aufgeworfen.

Diese Arbeit soll jedoch zeigen, dass nicht die territoriale Aufteilung eines Staates entscheidend ist für eine föderale Staatsform, sondern vielmehr ein föderales Denken und eine föderale Kultur, neben dem notwendigen rechtlichen Rahmen. Italiens Suche nach dieser föderalen Kultur, seine Bestrebungen, die politische Macht zu dezentralisieren, stehen denn auch im Zentrum dieser Arbeit. Sie zeigt auf, warum sich Italien trotz guten, rechtlichen Voraussetzungen nach wie vor schwer tut mit dieser föderalen Kultur, warum es dem Stiefel Europas auch nach dem Zusammenbruch der ersten Republik nicht gelungen ist, seine Staatsstruktur grundlegend und nachhaltig zu reformieren.
