Diese Publikation setzt sich kritisch mit zentralen Fragen des deutschen Strafrechts auseinander: Ist die Unterbringung in einem psychiatrischen Krankenhaus gemäß Paragraph 63 des Strafgesetzbuches ein blinder Fleck oder Graubereich des Rechtssystems? Ist der Fall des für rund sieben Jahre in der Psychiatrie untergebrachten Gustl Mollath als Symptom eines neoliberalen Umgangs mit vermeintlich psychisch kranken Tätern zu verstehen? Gegenstand der Veröffentlichung sind weiterhin die ab dem Jahr 2015 auf den Weg gebrachten Gesetzesanpassungen auf Bundesebene und in Bayern. Hier betrachtet der Autor, ob die neu geschaffenen Normen zur Verhinderung von Missbrauch im Maßregelvollzug geeignet sind. Zur Beleuchtung dieser Aspekte befasst sich die Arbeit damit, welchen Stellenwert psychiatrische Gutachten in der Unterbringungspraxis einnehmen und wo juristische und ethische Grenzen verlaufen. Die Untersuchung besitzt neben psychiatrischen und juristischen Aspekten einen in erster Linie kriminologischen Charakter. Nach einer Bestimmung relevanter Begriffe befasst sich der Verfasser mit dem Unterbringungsverfahren sowie der Unterbringungspraxis in Deutschland. Er stellt außerdem die gesetzlichen Neuregelungen auf dem Gebiet der strafrechtlichen Unterbringung vor. Zur Einordung der Abläufe im Fall Mollath hat der Verfasser auf fünf psychiatrische Gutachten sowie gerichtliche Entscheidungen zurückgegriffen.
