Spntestens seit der europarechtswidrigen Massenausweisung von Roma 2010 in Frankreich stellt sich fr die EU mit aller Schnrfe die Frage nach dem eigenen Verhnltnis zu ihrer grAten Minderheit: Wie lassen sich gesellschaftliche Strukturen handhaben, die bestimmte Minderheiten faktisch benachteiligen? Welche MAglichkeiten bieten der Vertrag von Lissabon und die EU-Antidiskriminierungsrichtlinie und vor allem, welche Weiterentwicklungen sind rechtlich mAglich? Nach einem allgemeinen berblick der vAlkerrechtlichen Minderheitenschutzstandards der Vereinten Nationen, der Organisation fr Sicherheit und Zusammenarbeit in Europa und des Europarates sowie der Rechtsprechung des Europnischen Gerichtshofes fr Menschenrechte beschnftigt sich die Arbeit vertieft mit der Definition einer (nationalen) Minderheit.Die Analyse zeigt, dass die Verweigerung, die Roma als solche anzuerkennen, einer juristischen Betrachtung nicht standhnlt. Die Arbeit bietet anschlieend eine umfassende Darstellung der Initiativen der EU im Hinblick auf die Situation der Roma. Sodann erfolgt eine eingehende Betrachtung des EU-Vertragsregelungswerks und der Rechtsprechung des Europnischen Gerichtshofes im Hinblick auf Minderheiten, Diskriminierungsschutz und positive Manahmen. Mittlerweile hat das Thema eine neue Dynamik erfahren. Im Juni 2011 haben die Staats- und Regierungschefs der EU einen EU-Rahmen fr nationale Strategien zur Integration der Roma verabschiedet."

Symbolic boundaries, cultural differences and ethnic conflicts have gained significance and new meanings in a global situation characterized by the dissolution of traditional political and societal structures.
