Entrepreneur and Nazi functionary Fritz Kiehn lived through almost 100 years of German history, from the Bismarck era to the late Bonn Republic. A successful manufacturer, Kiehn joined the Nazi Party in 1930 and obtained a number of influential posts after 1933, making him one of the most powerful Nazi functionaries in southern Germany. These posts allowed him ample opportunity to profit from “Aryanizations” and state contracts. After 1945, he restored his reputation, was close to Adenauer's CDU during Germany's economic miracle, and was a respected and honored citizen in Trossingen. Kiehn's biography provides a key to understanding the political upheavals of the twentieth century, especially the workings of the corrupt Nazi system as well as the “coming to terms” with National Socialism in the Federal Republic.

This book takes up the stimuli of new international historiography, albeit focusing mainly on the two regimes that undoubtedly provided the model for Fascist movements in Europe, namely the Italian and the German. Starting with a historiographical assessment of the international situation, vis-à-vis studies on Fascism and National Socialism, and then concentrate on certain aspects that are essential to any study of the two dictatorships, namely the complex relationships with their respective societies, the figures of the two dictators and the role of violence. This volume reaches beyond the time-frame encompassing Fascism and National Socialism experiences, directing the attention also toward the period subsequent to their demise. This is done in two ways. On the one hand, examining the uncomfortable architectural legacy left by dictatorships to the democratic societies that came after the war. On the other hand, the book addresses an issue that is very much alive both in the strictly historiographical and political science debate, that is to say, to what extent can the label of Fascism be used to identify political phenomena of these current times, such as movements and parties of the so-called populist and souverainist right.

Hierzu wird betrachtet, in welcher Beziehung Hatoums Körper zu seiner Umwelt steht, die sowohl konkret den Ausstellungsraum als auch politische Kontexte und kunsthistorische Referenzen meint. Des Weiteren wird analysiert, inwiefern ihr Körper sich als Subjekt behaupten und identifiziert werden kann. Im ersten Kapitel wird dafür auf eine Geschichte der Performance-Kunst zurückgegriffen. Im Vergleich zu den Wiener Aktionisten, die sich ebenfalls mit Krieg auseinandersetzen, sowie ein persönliches und gesellschaftliches Nachkriegstrauma aufarbeiten, wird die Funktion der Darstellung eines Kriegsopfers in Hatoums Performance untersucht. Im zweiten Kapitel wird die Bedeutung der Opferdarstellung für die Gesellschaft weitergehend analysiert. Welche Funktion übernimmt der Leichnam in der Gesellschaft und in welchem Verhältnis steht der Opferleib zur Welt? In Anbetracht des blutenden und scheinbar geöffneten Körpers, der seine Eingeweide entblößt, wird auch das Konzept des »Fragments« in Bezug auf eine „verlorene“ palästinensische Identität, Bilder von kannibalistischen Szenen, sowie eine moderne Lebenserfahrung hinterfragt. Der hierin schon als zerrissen und ambivalent angedeutete Körper wird daher im dritten Kapitel der Idee eines kompakten und ganzheitlichen Objekts der Minimal Art gegenübergestellt. Insbesondere Fragen nach Machtverhältnissen im Ausstellungsraum sowie dem Subjekt- bzw. Objektstatus eines Körpers wird hier im Vergleich von Hatoums Performancekörper zu Robert Morris’ Performativer Plastik Column (1960) nachgegangen. Zudem wird untersucht, mit welchen Mitteln Hatoums anonymer und verletzter Körper im Ausstellungsraum bei den BetrachterInnen welche Reaktionen hervorrufen kann. Wie kann das dargestellte Leid wahrgenommen und reflektiert werden? Im letzten und vierten Kapitel werden gewonnene Erkenntnisse genutzt, um Hatoums Positionierung in und Haltung zu einer westlichen Kunstgeschichte zu diskutieren.

Transconstitutionalism is a concept used to describe what happens to constitutional law when it is emancipated from the state, in which can be found the origins of constitutional law. Transconstitutionalism does not exist because a multitude of new constitutions have appeared, but because other legal orders are now implicated in resolving basic constitutional problems. A transconstitutional problem entails a constitutional issue whose solution may involve national, international, supranational and transnational courts or arbitral tribunals, as well as native local legal institutions. Transconstitutionalism does not take any single legal order or type of order as a starting-point or ultima ratio. It rejects both nation-statism and internationalism, supranationalism, transnationalism and localism as privileged spaces for solving constitutional problems. The transconstitutional model avoids the dilemma of 'monism versus pluralism'. From the standpoint of transconstitutionalism, a plurality of legal orders entails a complementary and conflicting relationship between identity and alterity: constitutional identity is rearticulated on the basis of alterity. Rather than seeking a 'Herculean Constitution', transconstitutionalism tackles the many-headed Hydra of constitutionalism, always looking for the blind spot in one legal system and reflecting it back against the many others found in the world's legal orders.

In most European countries, the horrific legacy of 1939–45 has made it quite difficult to remember the war with much glory. Despite the Anglo-American memory narrative of saving democracy from totalitarianism and the Soviet epic of the Great Patriotic War, the fundamental experience of war for so many Europeans was that of immense personal losses and often meaningless hardships. The anthology at hand focuses on these histories between the victors: on the cases of Hungary, Estonia, Poland, Austria, Finland, and Germany and on the respective, often gendered experiences of defeat. The book’s chapters underline the asynchronous transition to peace in individual experiences, when compared to the smooth timelines of national and international historiographies. Furthermore, it is important to note that instead of a linear chronology, both personal and collective histories tend to return back to the moments of violence and loss, thus forming continuous cycles of remembrance and forgetting. Several of the authors also pay specific attention to the constructed and contested nature of national histories in these cycles. The role of these ‘in-between’ countries – and even more their peoples’ multifaceted experiences – will add to the widening European history of the aftermath, thereby challenging the conventional dichotomies and periodisations. In the aftermath of the seventieth anniversary of 1945, it is still too early to regard the post-war period as mere history; the memory politics and rhetoric of the Second World War and its aftermath are again being used and abused to serve contemporary power politics in Europe
