Jahrhunderts, Sprache: Deutsch, Abstract: In der vorliegenden Arbeit wird dargestellt, inwiefern ein Künstler seinen wirtschaftlichen Interessen im deutschen sowie europäischen Raum nachgehen und diese schützen kann. Dazu werden im Kapitel 2 die Eigenschaften des Gutes Kunst betrachtet, wobei Kunst ausschließlich als privates Gut definiert wird, was somit die Ansprüche der Öffentlichkeit auf Kunst ausschließt (Kunst als öffentliches Gut). Im Kapitel 3 wird die Funktionsweise des Kunstmarktes beschrieben und das Verhältnis vom Künstler zum Galeristen genauer beleuchtet. Eine institutionenökonomische Untersuchung folgt im Kapitel 4. Das Ziel ist, auftretende Probleme darzulegen und die damit einhergehende Bedeutung von Schutzmöglichkeiten zur Lösung der Problematik aufzuzeigen. Daher wird die Analyse möglicher Schutzmaßnahmen im Kapitel 5 anhand des Urheberrechts, insbesondere des Folgerechts, welches im Urheberrecht verankert ist, erfolgen. Als Teil des Rechts des „geistigen Eigentums“ (Immaterialgüterrecht) schützt das Urheberrecht nach § 1 Urheberrechtsgesetz(UrhG) Werke der Literatur, Kunst und Wissenschaft. Zur bildenden Kunst gehören Werke der Malerei, Bildhauerei und Graphik, obwohl heutzutage eine klare Unterscheidung in Gattungen fast unmöglich ist (vgl. Schoenebeck, 2003, S.28 u. S.36f.). Die Arbeit beschränkt sich auf die Malerei. Im Zuge der Globalisierung wird auch der Kunsthandel internationalisiert, daher ist es wichtig, das Urheberrecht auch auf internationaler Ebene zu beurteilen und damit verbundene Probleme darzustellen. Die Betrachtung wird sich hierbei auf Europa konzentrieren(Kapitel 5). Das 6. Kapitel soll abschließend eine kurze Zusammenfassung sowie weitere relevante Faktoren aufzeigen. Neben den rechtlichen könnten auch technische Schutzmöglichkeiten für bildende Künstler als Grundlage der Analyse herangezogen werden, welche jedoch nicht Gegenstand dieser Arbeit sind.
