Das französische Umweltrecht erlebt - ähnlich wie das deutsche Recht - seit einiger Zeit eine Phase des Umbruchs und der Erneuerung. Noch vor nicht allzu langer Zeit war das Umweltrecht ein in Frankreich kaum beachtetes Randgebiet. Inzwischen ist es zunehmend in den Mittelpunkt rechtspolitischer Diskussionen gerückt und hat zahlreiche Reformen erfahren.Die Autorin verschafft in der vorliegenden Untersuchung einen Überblick über System und Besonderheiten des französischen Umweltrechts. Es wird der Versuch unternommen, seine Stärken und Schwachpunkte im Wege eines Vergleichs mit dem deutschen Umweltrecht herauszuarbeiten. Hierbei kommt dem Komplex des Rechtsschutzes Privater besondere Aufmerksamkeit zu. Um eine Verzerrung aufgrund systemspezifischer Besonderheiten in den einzelnen Rechtsgebieten (Zivil-, Verwaltungs- und Strafrecht) zu vermeiden, enthält die Untersuchung eine Gesamtbetrachtung der Regelungen in ihrem jeweiligen Funktionszusammenhang und im Licht des rechtlichen, politischen und sozialen Umfeldes.Die Verfasserin kommt zu dem Ergebnis, daß das französische Umweltrecht Defizite insbesondere beim Störungsschutz und vorläufigen Rechtsschutz aufweist. In anderen Bereichen ist es - im Vergleich - fortschrittlich. So sind etwa die Umweltverträglichkeitsprüfung, ein allgemeines Aktenzugangsrecht sowie die Zulässigkeit von Verbandsklagen seit vielen Jahren in Frankreich geltendes Recht. Die mit den fortschrittlichen Instrumenten gewonnenen Erfahrungen in Frankreich sind geeignet, die Debatte und Fortentwicklung des deutschen Rechts zu fördern.
