English summary: In Germany in particular, but in Austria as well, the consequences of the notary's involvement in legal procedures in which private individuals settle and organize their legal circumstances are increasingly often that the participants make the notary responsible for misplaced expectations that they placed on the contractual transaction in which he was involved. Gabriele Godl examines the individual activities of notaries in both countries, the legal relationship between those concerned and the notary and the legal basis for a liability. Whereas in German law there is a clear legal basis for subsidiarity, this is missing in Austria. German description: Die Mitwirkung des Notars an Rechtsvorgangen, mit denen Privatpersonen ihre rechtlichen Verhaltnisse regeln und gestalten, hat besonders in Deutschland - aber auch in Osterreich - immer haufiger zur Folge, dass Beteiligte die Verantwortung fur fehlgeschlagene Erwartungen, die sie mit dem notariellen Rechtsgeschaft verbunden haben, beim Notar suchen. Nicht selten wird so der Notar fur finanzielle Nachteile haftbar gemacht. Damit steht der Notar dem anspruchstellenden Burger im Rahmen des Haftungsanspruches nicht in offentlich-rechtlicher oder hoheitlicher Beziehung gegenuber, sondern als Gegner eines zivilrechtlichen Anspruches. Diese zivilrechtliche Verantwortlichkeit des Notars wirft insbesondere wegen seiner von Unabhangigkeit und Unparteilichkeit gepragten Stellung als Amtstrager zahlreiche Besonderheiten auf, die - was nicht immer adaquat berucksichtigt wird - ein ganz eigenstandiges Haftungssystem erfordert. Gabriele Godl untersucht zunachst die einzelnen Tatigkeiten der Notare beider Lander, die Rechtsverhaltnisse der Beteiligten zum Notar und die gesetzlichen Grundlagen fur eine Haftung. Dabei zeigt sich, dass das deutsche Haftungsrecht grundsatzlich vorzugswurdig erscheint, weil es die Spezifika des Notaramtes angemessener berucksichtigt als das osterreichische Recht. Anschliessend beleuchtet Gabriele Godl die Voraussetzungen eines Notarhaftungsanspruches und pruft, ob und inwieweit von osterreichischen Gerichten eine Nachrangigkeit der Notarhaftung ohne spezielle gesetzliche Grundlage praktiziert wird. Dazu untersucht sie die wesentlichen Begrundungsversuche fur eine Nachrangigkeit der Notarhaftung und vergleicht diese in ihren materiell-rechtlichen und prozessualen Konsequenzen mit dem deutschen Recht.

Finance and Modernization centres on a set of historical developments and problems typified by the long history of the Österreichische Creditanstalt and its successor organizations, and opens the way to compare and contrast experiences throughout Central and Western Europe and also on other continents. The structure of this volume reflects the changing role and nature of banks as economies become industrialized and modernized. Although banks adapt to the needs of an industrializing economy, at the same time, industrialization influences the manner in which banking systems grow and the structures which they adopt. Beginning with studies of the Austrian banks, their development and their crises, the volume then moves on to look at case studies of important aspects of financial activity - German stock markets, railroad investment, and information networks. This is followed by a section on country studies of banking modernization in Sweden, the Netherlands and Greece.
