This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.

Level of compliance - one of the most important prerequisites of good governance - varies widely across countries of the Global North and the less developed, Global South. Acts of non-compliance, such as electoral irregularities, dubious deals between private and public sectors, questionable role of the justice systems and financial scandals, though they vary greatly across countries, are an omnipresent reality of contemporary life. This volume has brought together a number of case studies of such deviant behavior in political, juridical and corporate fields, from several countries of Asia, Europe and South America, within a common framework. Instead of a moral approach based exclusively on the legality and illegality of the act, the authors of these essays dissect non-compliance analytically, taking culture and context into account. Das Gesundheitswesen in Deutschland "krankt" schon seit langem an fruchtlosen Reformdiskussionen und "Reförmchen", eine grundlegende Neuorientierung ist dagegen stets misslungen. Betroffen ist vor allem die Pflege, sei es in Form der stationären oder der häuslichen Pflege. Der allseits beklagte Pflegenotstand hat im Bereich der häuslichen Pflege die Bildung eines inzwischen hart umkämpften Marktes von osteuropäischen Pflegehilfen hervorgebracht bzw. provoziert. Die vorliegende Darstellung beleuchtet in diesem Zusammenhang "schlaglichtartig" diese facettenreiche Thematik unter Berücksichtigung jüngster gesetzlicher Entwicklungen, die aber nicht unbedingt zur Lösung der dringenden Probleme beitragen. Ein weiterer bedeutsamer und hier behandelter Aspekt der brisanten Thematik "Gesundheit" ist sicherlich die medizinische Versorgung, u.a. gekennzeichnet durch das Verhältnis Arzt/Krankenhaus - Patient. Unter dem Gesichtspunkt "Stärkung der Patientenrechte" hat der Gesetzgeber jüngst das neue Patientenrechtegesetz erlassen, dessen Sinnhaftigkeit teilweise aber bezweifelt wird. Für den Patienten soll nach dem Willen des Gesetzgebers nunmehr Rechtssicherheit und Klarheit über seine Rechte geschaffen werden. Ob dies durch das neue Regelwerk tatsächlich erreicht wird, ist eher fraglich. Behandelt wird in dieser Darstellung auch - geschuldet einem neuerlichen aktuellen und wiederum gescheiterten gesetzgeberischen Vorstoß der Bundesregierung - das nach wie vor kontrovers diskutierte wie gleichermaßen komplexe Thema "Sterbehilfe", teilweise verknüpft mit der im Betreuungsrecht wurzelnden Fragestellung nach der "Rechtssicherheit am Lebensende" durch Patientenverfügungen.
