Hace ya algunos a¤os en el seno del Departamento de Derecho civil de la Universidad de Alicante, entre distintas iniciativas tendentes a la potenciaci¢n del Derecho de da¤os, se decidi¢ acometer, cada cierto tiempo y sirvi‚ndose de acreditados especialistas, la organizaci¢n de unas jornadas nacionales sobre dicha disciplina, con el deseo a¤adido, en aras de la consecuci¢n de un mayor alcance, de que pudieran conocer ulteriormente la luz p£blica. Se pretend¡a con ello traer a colaci¢n, peri¢dicamente, aquellos aspectos de la responsabilidad civil que pudieran suscitar mayor inter‚s, sea por su novedad, repercusi¢n pr ctica, complejidad o por motivos de otra ¡ndole. Partiendo de tales premisas, surgieron las I Jornadas nacionales de responsabilidad civil, derivando tiempo m s tarde, tras las correspondientes adaptaciones, y en su caso ampliaciones de las intervenciones de sus ponentes, en la obra colectiva Perfiles de la responsabilidad civil en el nuevo milenio, Madrid, 2000. Con la ilusi¢n renovada tras constatarse la utilidad reportada de la referida iniciativa, se emprendieron las II Jornadas nacionales, desarroll ndose en el primer trimestre del pasado a¤o. Junto al an lisis de la problem tica m s trascendente ?sea por su delimitaci¢n o fundamentaci¢n? de la teor¡a general del Derecho de da¤os, se abord¢ la correspondiente a ciertos sectores o mbitos de da¤os, en particular: sanitario, accidentes de trabajo, veh¡culos de motor, propiedad intelectual e industrial, medioambiental, concursal, etc. El resultado fue la participaci¢n de casi medio centenar de ponentes, entre acreditados especialistas y relevantes aplicadores del Derecho, con la particularidad a¤adida en este £ltimo caso de haber podido contar incluso con la presencia de magistrados pertenecientes a las Salas de lo Civil, Contencioso-administrativo, Social y Penal del Tribunal Supremo y por ende de las Salas donde, con mayor o menor incidencia, la disciplina del Derecho de da¤os encuentra una concreta aplicabilidad. Ello vino a a¤adir, en el an lisis de ciertas tipolog¡as concretas de responsabilidad, una clara visi¢n de interrelaci¢n y con ello de mayor amplitud en el conocimiento y tratamiento de su problem tica. Seg£n creemos, la oportunidad que se ofrec¡a era cuanto menos inhabitual, por no decir excepcional, dentro de nuestro actual panorama jur¡dico. Como ocurriera en las primeras jornadas, los distintos participantes asumieron el compromiso de actualizar hasta fechas recientes sus intervenciones a efectos de su publicaci¢n. El resultado de ello es la presente obra donde se conjuga el prestigio de sus autores y el inter‚s por los temas tratados. Se ha logrado sin duda una obra dogm ticamente enriquecedora, £til para la pr ctica. Finalmente quiero aprovechar esta presentaci¢n para agradecer muy sinceramente a todos los autores, que con su gran disponibilidad y esfuerzo han hecho posible la edici¢n de este libro, como asimismo a todos los miembros del Departamento de Derecho civil de la Universidad de Alicante, por las grandes dosis de profesionalidad e ilusi¢n de que han hecho gala en todo momento en aras de la culminaci¢n de la referida iniciativa. We are publishing this book as the result of a research project carried out by the University of Las Palmas de Gran Canaria in Spain and AFM Krakow University in Poland. Some parts of it were already announced during a scientific Conference organised remotely in Kraków in October 2020. It is now time to present the research findings in writing.The issue of Artificial Intelligence has long raised questions and interests, including those of legal science. A number of problems have not yet been widely analysed, despite the fact that the present time is undoubtedly a time of technological challenges. This book adopts the proposition that it is possible to the customs to be sources of contractual obligations. To support that premise, it was necessary to seek jurisprudential (arbitration and litigation) and comparative basis. Even more, due to contract law internationalization, customary international sources should be subject of domestic treatment, as they provide contractual obligations as well as they work as contractual interpretation tool. However, one can´t neglect the need to control the customary content. In detailed terms, then, we can say that the role reserved for the custom as contractual law rules source has always been residual in Brazilian law. Accompanying the modern European experience, doctrine and Brazilian legislation emphasize the secondary, when not merely interpretive, role of the contractual custom. In turn, Brazilian case law wasn´t able to give general treatment to contractual custom. Moreover, the process of reducing distances and cultural, social and economic approximation, usually called globalization, influenced the contracts through the incorporation of a number of solutions brought from the international trade practice. Although they might be justified by the age-old principle of freedom, somehow these international "uses" insinuate themselves into Brazil to the point of requiring that the Brazilian Courts themselves to give them treatment and shelter. On one side, if you deny the existence of a creative normative role in contractual custom by another, albeit indirect, is recognized not only their existence but the possibility of foreign origin. This paradoxical treatment reflects, to some extent, another consequence: the Brazilian contract law is in the process of internationalization. Here, then, a new confrontation is announced: a broad creative freedom (a tributary of the so-called Lex mercatoria) and the foreign act incorporation control (public policy). Unlike before, however, no simplistic answer would be feasible, particularly because of the complexity of contemporary and regulatory Brazilian contract law.

This book contends that the right of access to justice (at national and international levels) constitutes a basic cornerstone of the international protection of human rights, and conforms a true right to the Law. It amounts, lato sensu, to the right to the realization of justice. In such understanding, it comprises not only the formal access to a tribunal or judge, but also respect for the guarantees of due process of law, the right to a fair trial, and to reparations (whenever they are due), and the faithful execution of judgments. On its part, the right to an effective domestic remedy is a basic pillar of the rule of law in a democratic society. In its part, the right of international individual petition, together with the safeguard of the integrity of international jurisdiction, constitute the basic foundations of the emancipation of the individual vis-à-vis his own State. This is a domain that has undergone a remarkable development in recent years. It is submitted that the right of access to justice belongs today to the domain of jus cogens. Without it, there is no legal system at all. The protection of the human person in the most adverse circumstances has evolved amongst considerations of ordre public. Such recent evolution has been contributing to the gradual expansion of the material content of jus cogens. Furthermore, the very notion of "victim" (encompassing direct, indirect and potential victims) has been the subject of a considerable international case-law. Victims have had their cause vindicated in situations of utmost adversity, if not defencelessness (e.g., abandoned or "street children", undocumented migrants, members of peace communities in situations of armed conflict, internally displaced persons, individuals in infra-human conditions of detention, surviving victims of massacres).
