Derecho aéreo para pilotos de drones es una obra dirigida a pilotos o profesionales que necesiten consultar la normativa vigente en esta materia. El contenido, desarrollado teniendo en cuenta las recomendaciones del Apéndice I de los Medios Aceptables de Cumplimiento dictado por la Agencia Estatal de Seguridad Aérea, se estructura en diez capítulos que abarcan desde los conceptos elementales de derecho aeronáutico hasta la normativa internacional, europea e interna que resulta de aplicación a la operación de vuelo de estas aeronaves. Así mismo, se detallan los requisitos del operador y del piloto, y los equipos y el uso del espacio aéreo, actualmente regulados en el Real Decreto 1036/2017, de 15 de diciembre, por el que se regula la utilización civil de las aeronaves pilotadas por control remoto. A lo largo del texto, se recoge también una selección de la normativa complementaria reguladora de la investigación de accidentes e incidentes y notificación de sucesos en la aviación civil, así como las responsabilidades administrativa, civil y penal en que puede incurrir el operador. Al final se incluye un Anexo introductorio a la nueva legislación europea que será aplicada progresivamente en España, desarrollada en los siguientes textos normativos: --- Reglamento Delegado (UE) n.° 2019/945 de la Comisión, de 12 de marzo de 2019, sobre los sistemas de aeronaves no tripuladas (UAS) y los operadores de terceros países de sistemas de aeronaves no tripuladas. --- Reglamento de Ejecución (UE) n.° 2019/947 de la Comisión, de 24 de mayo de 2019, relativo a las normas y procedimientos aplicables a la utilización de aeronaves no tripuladas. La autora, Manuela Navarro Peral, es licenciada en Derecho y diploma en Estudios Avanzados en Derecho Mercantil por la Universidad de Granada.

This open access book disseminates some of the results of the European H2020 AiRT Project (Technology transfer of RPAs for the creative industry). In particular, it presents findings related to mitigating safety and security concerns when civil drones are piloted by the service sector (mainly, the creative industry). European policies regarding drones generally focus on outdoor drones, but they are also used indoors. Moreover, a number of European countries have fragmented regulations on drone use, and as a result, European institutions are attempting address these issues. This work is based on a detailed study of the European policies, a comparative analysis of the regulation in various European countries, an analysis of the drone sector in Europe, and primary data from members of the creative industry. The authors created focus groups in Spain, the UK and Belgium in order to discuss with the creative industry the concerns on safety and security when using civil drones for their work. The public debate over civilian use of drones is intensifying. Variously called "unmanned aircraft systems", "unmanned aerial vehicles", "remotely piloted aircraft", or simply "drones", they are available for purchase by anyone for a few hundred to a few thousand dollars. They have strikingly useful capabilities. They can carry high-definition video cameras, infrared imaging equipment, sensors for aerial surveying and mapping. They can stream their video in real time. They have GPS, inertial guidance, magnetic compasses, altimeters, and sonic ground sensors that permit them to fly a preprogrammed flightplan, take off and land autonomously, hover and orbit autonomously with the flick of a switch on the DRone Operator’s ("DROPs") console. The benefits they can confer on law enforcement, journalism, land-use planning, real estate sales, critical infrastructure protection and environmental preservation activities are obvious. However, their proliferation in response to these demands will present substantial risks to aviation safety. How to ensure the safety of drone operations perplexes aviation regulators around the world. They are inexpensive consumer products, unsuited for traditional requirements for manned aircraft costing hundreds of thousands or millions of dollars and flown only by licensed pilots who have dedicated significant parts of their lives and their wealth to obtaining licenses. Regulatory agencies in Europe and Asia are ahead of US regulators in creating spaces for commercial use. Over the next several years, legal requirements must be crystallized, existing operators of helicopter and airplanes must refine their policy positions and their business plans to take the new technologies into account, and all businesses from the smallest entrepreneur to large conglomerates must decide whether and how to use them. Domesticating Drones offers rigorous engineering, economics, legal and policy theory and doctrine on this important and far-reaching development within aviation.
