La obra incluye tres trabajos fundamentales del Profesor Summers sobre teoría de la argumentación y la interpretación en los sistemas del Common law. El trabajo más importante de Summers dedicado al razonamiento jurídico es un artículo del año 1978. ROBERT S. SUMMERS (1933-2019), fue profesor McRoberts de Derecho en la Universidad de Cornell, Ithaca, N.Y. De gran prestigio internacional por su trabajo en contratos, derecho comercial, jurisprudencia y teoría del Derecho. Fue autor y coautor de múltiples trabajos en estos campos, por los cuales recibió diversos títulos honoríficos y otros reconocimientos. Su tratado sobre el Uniform Commercial Code, en coautoría con James White, es el más citado sobre el tema por tribunales y académicos. Se desempeñó como asesor oficial tanto de la Comisión de Redacción para el Código Civil Ruso y a la Comisión Redactora del Código Civil Egipcio. En el ámbito de la teoría del derecho publicó, entre otros libros: Interpreting Precedent. A Comparative Study, en colaboración con N. MacCormick (1997), Form and Substance in Anglo-American Law, en colaboración con P.S. Atiyah (1987), Lon L. Fuller (1984), Instrumentalism and American Legal Theory (1982).

This is the English version of Jerzy Wroblewski's major work in Polish, S~dowe Stosowania Prawa (translated in his own preferred terms as 'The Judicial Application of Law'). The present translation arose out of a visit by the author to Scotland in 1989. In that year, the Carnegie Trust for the Universities of Scotland made it possible for Jerzy Wroblewski to spend six months as a Carnegie Fellow in the Centre for Criminology and the Social and Philosophical Study of Law at the University of Edinburgh. During that time he took a notably active part in the intellectual life of the Centre and the Faculty of Law. He gave freely of his time in teaching and advising students and also produced a series of original articles on topics connected with legal reasoning and law and computers. His major task while he was here, however, was to prepare a translation of S~dowe Stosowania Prawa, and this he accomplished to the extent of completing a preliminary draft. Zenon Bankowski and Neil MacCormick were to help him in improving this linguistically and preparing the final text for publication. Wroblewski warned us, having finished his draft with great labour, that the greater labour would be in the polishing of it. For we would have, as he joked, 'to translate my English into English'. And certainly, we found it extremely time-consuming, so as to defy completion during his stay in Edinburgh.

El aforamiento consiste en la sujeción a fuero especial, distinto del ordinario, lo que comporta que el conocimiento de la causa contra un aforado no corresponde al mismo tribunal que al resto de los ciudadanos sino al tribunal que la Constitución o la ley expresamente establezca y que se convierte en su «juez ordinario predeterminado por la ley» en el sentido del artículo 24 CE. La Constitución española establece el aforamiento ante la Sala de lo Penal del Tribunal Supremo para diputados y senadores (art. 71) y para el Presidente y demás miembros del Gobierno (art. 102), pero a través de la ley orgánica respectiva se ha extendido a los magistrados del Tribunal Constitucional y a los vocales del Consejo General del Poder Judicial, órganos constitucionales coesenciales a nuestro sistema de Gobierno, y con debilísimo fundamento a los titulares de los órganos de relevancia constitucional o auxiliares de las Cortes Generales como son el Tribunal de Cuentas y el Defensor del Pueblo, y, en fin, por la vía de la Ley Orgánica del Poder Judicial, a los miembros del Consejo de Estado. El aforamiento de los jueces y magistrados en la Ley Orgánica del Poder Judicial, así como de los fiscales, es el numéricamente más llamativo, pero se justifica plenamente por coherencia y congruencia con la dependencia exclusiva de la ley que se predice de los jueces y magistrados y de los fiscales. En cambio, la extensión con pretensión uniformizadora en el ámbito autonómico no solamente no reposa sobre bases sólidas, sino que requiere una «cierta poda» por utilizar palabras del prologuista Antonio del Moral. El libro examina también el aforamiento de las Fuerzas y Cuerpos de Seguridad del Estado, que es en realidad una regla especial de competencia sobre el órgano de enjuiciamiento, y el de los altos mandos militares, y se detiene en el de la Familia Real que estableció la Ley Orgánica 4/2014, de 1 de julio.
