La tesis central de este libro es que la noción de justicia funciona como puente entre el Derecho, en tanto que práctica social compleja orientada a fines y valores, y la utopía, en tanto que representación de una jerarquía de valores percibida como moralmente superadora de otras. Para ello, se proponen argumentos conceptuales e históricos en favor de esa conexión, desde una perspectiva iusfilosófica pospositivista y desde una perspectiva utopológica transdisciplinar. Se distingue entre utopías literarias, teóricas y prácticas y se procura mostrar la conexión en los tres ámbitos, revisando la obra de autores clásicos como Moro, Campanella, Harrington y Hume, pero también contemporáneos, como Bloch, Rawls, Nozick y Van Parijs. Esos distintos esfuerzos se orientan a resaltar que, desde una concepción del Derecho como práctica social, resulta provechoso interactuar con las visiones sociales críticas de las utopías. La esperanza del trabajo es que este pueda servir como material para desarrollar un enfoque "Derecho y utopía".

In the first half of the twentieth century, a charismatic Peruvian Amazonian indigenous chief, José Carlos Amaringo Chico, played a key role in leading his people, the Ashaninka, through the chaos generated by the collapse of the rubber economy in 1910 and the subsequent pressures of colonists, missionaries, and government officials to assimilate them into the national society. Slavery and Utopia reconstructs the life and political trajectory of this leader whom the people called Tasorentsi, the name the Ashaninka give to the world-transforming gods and divine emissaries that come to this earth to aid the Ashaninka in times of crisis. Fernando Santos-Granero follows Tasorentsi’s transformations as he evolved from being a debt-peon and quasi-slave to being a slave raider; inspirer of an Ashaninka movement against white-mestizo rubber extractors and slave traffickers; paramount chief of a multiethnic, anti-colonial, and anti-slavery uprising; and enthusiastic preacher of an indigenized version of Seventh-Day Adventist doctrine, whose world-transforming message and personal influence extended well beyond Peru’s frontiers. Drawing on an immense body of original materials ranging from archival documents and oral histories to musical recordings and visual works, Santos-Granero presents an in-depth analysis of chief Tasorentsi’s political discourse and actions. He demonstrates that, despite Tasorentsi’s constant self-reinventions, the chief never forsook his millenarian beliefs, anti-slavery discourse, or efforts to liberate his people from white-mestizo oppression. Slavery and Utopia thus convincingly refutes those who claim that the Ashaninka proclivity to messianism is an anthropological invention.

Esta tesis doctoral versa sobre los Derechos Humanos de Tercera Generación, en especial referencia al Derecho al Desarrollo. Tratase de un abordaje propositiva con respecto a la contribución del Poder Judicial para el desarrollo socio-económico, a partir de una perspectiva interdisciplinario entre el neoinstitucionalismo económico y algunas divisiones del Derecho, especialmente el Internacional Público, Constitucional y Procesal Civil, con algunas incursiones en la Filosofía del Derecho. Algunas ideas claves son presentadas con resalto de la importancia y valorización de los Derechos Humanos, como la de considerar que la existencia digna del hombre en la faz de la tierra está inexorablemente condicionada por los derechos humanos, tanto los derechos civiles y políticos cuanto por los derechos económicos, sociales y culturales y, especialmente, por los derechos de tercera dimensión: al medio ambiente, a la paz universal y al desarrollo de los individuos y de los pueblos. Para la realización efectiva de estos Derechos Humanos se exige la participación de todos. Así sobresale la actuación de la Justicia, por medio de la protección a esos derechos.
