Este libro aborda la problemática de la protección de la propiedad intelectual en Internet, tanto desde una perspectiva dogmática como práctica. Además, se incluye una visión de Derecho comparado sobre este asunto, así como la jurisprudencia más reciente. Primero incorpora una panorámica general de la propiedad intelectual y sus relaciones con Internet, examinando las causas de la permanente tensión entre ambas. Más adelante se analiza el fenómeno del «pirateo», es decir, la descarga y otros modos de difusión, como el streaming, de obras protegidas por los derechos de autor a través de Internet sin contar con la correspondiente autorización, fenómeno que ha sido asumido por una parte importante de la población. A continuación, se examinan los mecanismos protectores clásicos, penales y civiles, sus problemas y carencias, la práctica jurisprudencial y las últimas reformas operadas en el Código Penal, el texto refundido de la Ley de Propiedad Intelectual y la Ley de Enjuiciamiento Civil. Después se desbroza el nuevo instrumento de defensa de la propiedad intelectual en Internet introducido en el año 2011 y conocido popularmente como «ley Sinde-Wert». Este novedoso mecanismo administrativo, cuya aplicación va a corresponder a la Administración pública, es objeto de un estudio sistemático y minucioso: no sólo se explica su naturaleza jurídica y caracteres, sino también el procedimiento, sus efectos y consecuencias, dando respuestas a los diversos interrogantes y problemas que plantea su configuración legal y reglamentaria desde un punto de vista práctico. En definitiva, este libro constituye un estudio exhaustivo y práctico al nuevo mecanismo administrativo de protección de la propiedad intelectual en Internet, que contiene un tratamiento jurídico actual que la hace imprescindible como obra de consulta práctica para profesionales del Derecho, autores, productores y demás sujetos que se ven involucrados en esta materia. Moisés Barrio Andrés es Letrado del Consejo de Estado, Doctor en Derecho por la Universidad Carlos III de Madrid, Máster en Investigación en Ciencias Jurídicas por ICADE, ESADE y Deusto, y Licenciado en Derecho por ICADE (E-1). Además, cuenta con más de doce años de experiencia profesional en esta materia como abogado ejerciente del Ilustre Colegio de Abogados de Madrid. Igualmente ha realizado estudios de postgrado en la Universidad de Harvard, es Profesor de la Regulación económica y Derecho de las Telecomunicaciones e Internet, es Académico correspondiente de la Real Academia de Jurisprudencia y Legislación y es Secretario de la Revista «Documentación Administrativa». In any country where there is a Bill of Rights, constitutional rights reasoning is an important part of the legal process. As more and more countries adopt Human Rights legislation and accede to international human rights agreements, and as the European Union introduces its own Bill of Rights, judges struggle to implement these rights consistently and sometimes the reasoning behind them is lost. Examining the practice in other jurisdictions can be a valuable guide. Robert Alexy's classic work reconstructs the reasoning behind the jurisprudence of the German Basic Law and in doing so provides a theory of general application to all jurisdictions where judges wrestle with rights adjudication. In considering the features of constitutional rights reasoning, the author moves from the doctrine of proportionality, procedural rights and the structure and scope of constitutional rights, to general rights of liberty and equality and the problem of horizontal effect.
