En América Latina, el catolicismo es un poder cultural que ha tenido una influencia muy grande sobre diversos campos sociales como la educación, el derecho y el arte. Asimismo, en los últimos años, el panorama político latinoamericano ha esta marcado por el renovado interés de los viejos y los nuevos grupos religiosos por participar activamente en el debate público. Tomando en cuenta la fuerza que el cristianismo tiene en nuestro contexto, el objeto del presente volumen es contribuir a superar el confesionalismo que ha dominado el ordenamiento jurídico colombiano. Se ofrecen para ello doce contribuciones que conjugan perspectivas jurídicas, socio-jurídicas. históricas, feministas y/o museológicas, y se analizan algunos de los desafíos del Estado laico, reflexionando sobre la familia, los derechos de las mujeres y de las personas LGBTIQ . Se estudian conflictos alrededor de la laicidad en el sector educativo, como los generados por la presencia de símbolos religiosos. La relación entre laicidad y neutralidad en el campo de la cultura, los museos y el patrimonio cultural es otro ámbito de análisis y discusión. Asimismo, son motivo de reflexión las tensiones que surgen entre la objeción de conciencia y las creencias religiosas de funcionarios públicos. Particular mención merecen dos contribuciones sobre el Estado y la religión en India y en Alemania, que enriquecen el complejo panorama, desde una visión comparada. Esta obra, ante todo, es un llamado académico a la investigación interdisciplinaria, a la inclusión y comprensión de movimientos ciudadanos tradicionalmente excluidos, al estudio sobre las relaciones actuales entre el Estado y las religiones. Y es un comienzo de respuesta a los desafíos que impone el regreso de la religión a una sociedad que no está secularizada. Una lectura grata, necesaria y actual para estudiantes, investigadores y el público en general.

Colombia es formalmente un Estado laico porque así lo ha establecido la Corte Constitucional. Sin embargo, el modelo de laicidad creado por ese tribunal se asemeja más a un modelo de pluriconfesionalidad. Lo anterior porque existen varias disposiciones constitucionales que valoran positivamente el fenómeno religioso. Igualmente, porque la mayoría de las prerrogativas y los beneficios de los que gozaba la antigua organización religiosa oficial no desapareció con la entrada en vigor de la nueva carta política. Estos por regla general, se extendieron a las demás organizaciones religiosas que lo han solicitado. Este particular modelo tiene varias fisuras que lo alejan de los presupuestos teóricos mínimos de un Estado laico. En esta obra se abordará una de las fisuras más significativas, que ponen en evidencia las debilidades del nuestro modelo de laicidad. En efecto, desafortunadamente el legislador ha incluido en el catálogo del patrimonio cultural varios bienes y manifestaciones católicos que no tienen una gran connotación cultural. Estas declaratorias no vienen acompañadas de planes para la protección de los supuestos valores culturales que represen-tan los bienes y manifestaciones, lo cual permite inferir que el Congreso no actuó motivado por una intención de protección de la cultura. En contraste, de un estudio de estas leyes se puede advertir que existe un interés en crear un título jurídico que justifique la transferencia de recursos públicos a la Iglesia católica. La anterior estrategia no solo desdibuja el carácter laico del Estado, sino que también desnaturaliza la figura del patrimonio cultural al incluir en ese catálogo bienes y manifestaciones que no tienen el suficiente valor cultural.
