Uno de los temas que ha suscitado un más amplio debate en el ámbito público en los últimos años es el de la existencia de ciertas prerrogativas conferidas por la propia Constitución a individuos específicos por razón del cargo que ocupan en las Cortes Generales. Las prerrogativas parlamentarias suponen una ruptura del principio de igualdad, ya que prevén un trato diferente a los parlamentarios respecto del previsto para el resto de los ciudadanos y, además, en cuanto pueden afectar al derecho a la tutela judicial de terceros, implican un riesgo potencial para los derechos fundamentales. No obstante, resulta esencial explicar de manera detallada el propósito, la justificación y, especialmente, el alcance de dichas prerrogativas. En este trabajo se realiza una distinción clara entre las tres prerrogativas (inviolabilidad, inmunidad y fuero especial), intentando ofrecer una descripción no solo de su naturaleza jurídica, sino también de su evolución a lo largo de la historia constitucional, junto con los significativos fallos jurisdiccionales que han recaído sobre estas instituciones. Es innegable que se trata de unas instituciones muy cuestionadas y criticadas —aunque no todas en la misma medida ni con la misma intensidad—, no solo por lo que tienen de privilegio (o, si se quiere, de ruptura con el principio de igualdad), sino también por lo que suponen de reflejo de la crisis del sistema parlamentario y de replanteamiento del propio sistema representativo. Y ello debe hacernos cuestionar no solo su justificación actual, sino también los problemas que su regulación plantea en nuestro ordenamiento.
