El Derecho Internacional de los Refugiados (DIR) definió la condición de refugiado como una situación excepcional y, por ello, como una figura ‘humanitaria’, lo que tuvo como consecuencia hacer del refugio una situación excluida de la dimensión política de los derechos. Algunos autores (Nyers, 2006; Agamben, 1998; Arendt, 1974) encuentran que con esta definición se instauró una ‘inclusión’ aparente de las personas refugiadas en los países de destino, precisamente desde su exclusión como sujetos con agencia política, lo cual ha constituido un contrasentido. Este estudio se ocupa de este contrasentido que se presenta como ‘La paradoja del refugio’.
