The biography of the infamous judge who oversaw Nazi justice for the Third Reich as president of the “People’s Court.” Though little known, the name of the judge Roland Freisler is inextricably linked to the judiciary in Nazi Germany. As well as serving as the State Secretary of the Reich Ministry of Justice, he was the notorious president of the “People’s Court,” a man directly responsible for more than 2,200 death sentences; with almost no exceptions, cases in the “People’s Court” had predetermined guilty verdicts. It was Freisler, for example, who tried three activists of the White Rose resistance movement in February 1943. He found them guilty of treason and sentenced the trio to death by beheading; a sentence carried out the same day by guillotine. In August 1944, Freisler played a central role in the show trials that followed the failed attempt to assassinate Adolf Hitler on 20 July that year—a plot known more commonly as Operation Valkyrie. Many of the ringleaders were tried by Freisler in the “People’s Court.” Nearly all of those found guilty were sentenced to death by hanging, the sentences being carried out within two hours of the verdicts being passed. Roland Freisler’s mastery of legal texts and dramatic courtroom verbal dexterity made him the most feared judge in the Third Reich. In this in-depth examination, Helmut Ortner not only investigates the development and judgments of the Nazi tribunal, but the career of Freisler, a man who was killed in February 1945 during an Allied air raid.

Of all victims of Nazi persecution, German Jews had to suffer the Nazi yoke for the longest time. Throughout the Third Reich, they were exposed to anti-Jewish propaganda, discrimination, anti-Semitic laws and increasingly to outrages and offences by non-Jewish Germans. While the International Military Tribunal and the subsequent American Military Tribunals at Nuremberg dealt with a variety of Nazi crimes according to international law, these courts did not consider themselves cognizant in adjudicating wrongdoings against German citizens and those who lost German citizenship based on the so-called “Nuremberg laws,” such as Germany’s Jews. Until recently, scholarship failed to explore this task of the German judiciary in more detail. Edith Raim fills this gap by showing the extent of the crimes committed against Jews beyond the traditionally known facts and by elucidating how the West German administration of justice was reconstructed under Allied supervision.

FOREWARD This book contains the description of my life. It bears witness to important and influential events that have shaped the history of these times, which I, the author, have taken part in or been subject to. Many events over the past decades have directly or indirectly influenced the lives of my family as well as my own. That in itself is not enough reason to write a book - a book should also offer something to others. Above all, this work presents the characters of people I have met during my long life, but also, for those who are first getting to know me through this book, it gives an account of the circumstances that led me to experience this life as it is represented here. I am no historian, but I consider it to be historically necessary to clarify these circumstances and also to describe them, to prevent them from being forgotten in our society. The question asked of me: "Grandpa, are you a murderer?" finally gave me the incentive to take up the pen. Why did my granddaughter ask me that question? She read the Frankfurt General Newspaper. There was a report on my trial at the Federal Court. But even before that, it had been addressed by many people on several occasions. She was absolutely frightened, she said it is really terrible when people spread these kind of rumors about other people. But nevertheless, she still asked me: "Grandpa, are you a murderer?" What answer should I give her? What can I tell her? How can I tell her, that I am no murderer? Or am I? They did convict me, after all! Why do some insist I am a murderer? The people want it that way. The people? Those who speak in the name of the people's justice, or who have spoken, probably need a scapegoat. But all those who take the trouble to read this, my record, are also the people. If some of them set the book aside, then perhaps these people have the same doubts that I and many others have had.So, how do I answer her? Don't worry, it was a false sentence, that won't be enough. The young people of today ask questions, they are critical. That is why an easy answer won't be sufficient. Is it enough to tell her: I prevented a border guard from shooting and killing your father, who was 11 years old at the time, and your uncle, 5 years old, and your grandma and grandpa? From killing them, because the guards had their orders from the state - orders in the name of the people. Can the people of today imagine what was happening at the wall in those times?

Why are certain methods of punishment adopted or rejected in a given social situation? To what extent is the development of penal methods determined by basic social relations? The answers to these questions are complex, and go well beyond the thesis that institutionalized punishment is simply for the protection of society. While today's punishment of offenders often incorporates aspects of psychology, psychiatry, and sociology, at one time there was a more pronounced difference in criminal punishment based on class and economics. Punishment and Social Structure originated from an article written by Georg Rusche in 1933 entitled "Labor Market and Penal Sanction: Thoughts on the Sociology of Criminal Justice." Originally published in Germany by the Frankfurt Institute of Social Research, this article became the germ of a theory of criminology that laid the groundwork for all subsequent research in this area. Rusche and Kirchheimer look at crime from an historical perspective, and correlate methods of punishment with both temporal cultural values and economic conditions. The authors classify the history of crime into three primary eras: the early Middle Ages, in which penance and fines were the predominant modes of punishment; the later Middle Ages, in which harsh corporal punishment and capital punishment moved to the forefront; and the seventeenth century, in which the prison system was more fully developed. They also discuss more recent forms of penal practice, most notably under the constraints of a fascist state. The majority of the book was translated from German into English, and then reshaped by Rusche's co-author, Otto Kirchheimer, with whom Rusche actually had little discussion. While the main body of Punishment and Social Structure are Rusche's ideas, Kirchheimer was responsible for bringing the book more up-to-date to include the Nazi and fascist era. Punishment and Social Structure is a pioneering work that sets a paradigm for the study of crime and punishment.
