Several years after the first Greek bailout, the integration project of the European Union faces an interlocking set of political, economic, legal and social challenges that go to the very core of its existence. Austerity is the order of the day, and citizens in both debtor and creditor states increasingly turn to the political movements of the far left and right, anti-politics and street protests to vent their frustration. This book demonstrates the limits of constitutionalism in the EU. It explores the ‘twin crises’ - the failure of the Constitutional Treaty in 2005 and the more recent Eurozone crisis - to illuminate both the possibilities and pitfalls of the integration project. It argues that European integration overburdened law in an attempt to overcome deep-seated political deficiencies. It further contends that the EU shifted from an unsuccessful attempt at democratisation via politicisation (the Constitutional Treaty), to an unintended politicisation without democratisation (the Eurozone crisis) only a few years later. The book makes the case that this course is unsustainable and threatens the goal of European unity. This text will be of key interest to students and scholars in the fields of EU studies, EU law, democracy studies, constitutional studies and international relations.

Der Wettbewerb, früher Inbegriff einer herrschaftsfreien Ordnung, wird als Mittel zur Herstellung von Gemeinwohl thematisiert. Taugt der Schutz des freien und unverfälschten Wettbewerbs noch als positives Ziel und normativer Fluchtpunkt des europäischen Wirtschaftsrechts? Oder sind die Europäische Union und ihr Wettbewerbsrecht von den Grundrechten her neu zu denken? Gibt es gar ein eigenes Grundrecht auf Wettbewerbsfreiheit? Jan Henrik Klement wendet sich dagegen, Freiheit und Ordnung in einem institutionellen Freiheitsbegriff zu amalgamieren und das europäische Recht zu vergrundrechtlichen. Am Beispiel des Kartellrechts zeigt er aber auch, dass die Grundrechte nicht bloß "systemfremde" Zutaten des Wettbewerbsrechts sind. Die Deutsche Bank steht in dem Verdacht, dass sie in ihren eigenen Reihen die Entstehung von Subkulturen zugelassen hat, deren kriminelle Energie und Schadensträchtigkeit das Leistungsspektrum jedweder Mafia-Organisation bei weitem übertreffen. Sie ist mit Sanktionen unterschiedlicher Rechtsqualität in Höhe von derzeit circa. 10 Milliarden Euro belastet. Durch zahllose Rechtsstreitigkeiten, Risiken und neue Verdachtsgründe sieht sich die Deutsche Bank darüber hinaus zur Bildung von Rückstellungen in Höhe von mehreren Milliarden Euro gezwungen. Die gegen die Deutsche Bank erhobenen Vorwürfe betreffen auch das "Herzstück" der Organisierten Kriminalität: Geldwäsche. Die Liste laufender Prozesse, strafrechtlicher Ermittlungen und aufsichtsrechtlicher Untersuchungen ist lang. Fehler und Verbrechen haben immer nur die anderen begangen und persönliche Konsequenzen zieht man erst dann, wenn der öffentliche Druck zu groß geworden ist. Die deutsche Politik verweigert selbst nach jahrzehntelangen Debatten Antworten auf die Frage nach strafrechtlichen Haftungen und verharrt dogmatisch in der Steinzeit. Wolfgang Hetzer analysiert, wie es dazu kommen konnte und zeigt vor allem auch, was passieren muss, um diesem verantwortungslosen Treiben ein Ende zu setzen.
