National Policy Statements (NPS) are a key component of the new planning system for nationally significant infrastructure projects, introduced by the Planning Act 2008. The Act stipulates that a proposal for a National Policy Statement will be subject to public consultation and allows for parliamentary scrutiny before designation as national policy by the Secretary of State. The draft Ports National Policy Statement (Department for Transport, 2009) has been welcomed by many organisations as a good start which can be built upon. The Committee has recommended a number of modifications and expects the Department will improve the draft as a result of the consultation and scrutiny processes. The Committee has reservations regarding the Government's 2007 policy for ports and the lack of guidance on location for port development in the NPS but this, of itself, does not make the NPS unfit for purpose. But the Committee cannot recommend designation at this stage on two counts. Firstly, a key, related policy statement - the National Networks NPS - has yet to be published. Secondly, the organisation likely to be one of the principal decision-makers for port development - the Marine Management Organisation - has yet to be established and so has been unable to comment on guidance that will be of great importance to its role. These are fundamental flaws in the consultation process and the Ports NPS should not be designated until they are rectified.

The UK Government, the Scottish Government, Welsh Assembly Government and Northern Ireland Executive are taking action to achieve clean, healthy, safe, productive and biologically diverse oceans and seas. A new system of marine planning has been introduced through the Marine and Coastal Access Act 2009 (ISBN 9780105423096), the Marine (Scotland) Act 2010 (ISBN 9780105901518) and proposed legislation in Northern Ireland. This marine policy statement (MPS) is the framework for preparing marine plans and taking decisions that affect the marine environment. This consultation document contains the draft MPS, a non-technical summary of the appraisal of sustainability and an impact assessment. These and other documents are available at www.defra.gov.uk/corporate/consult/marine-policy/index.htm. The introduction sets out the purpose, scope and structure of the MPS. Chapter 1 describes the role of the MPS within the wider marine planning system and its interaction with existing planning regimes. Port Development and Competition in East and Southern Africa analyzes the 15 main ports in East and Southern Africa (ESA) to assess whether their proposed capacity enhancements are justified by current and projected demand; whether the current port management approaches sufficiently address not only the maritime capacity needs but also other impediments to port efficiency; and what the expected hierarchy of ports in the region will be in the future. The analysis confirms the need to increase maritime capacity, as the overall container demand in the ports in scope is predicted to begin exceeding total current capacity by between 2025 and 2030, while gaps in terms of dry and liquid bulk handling are expected even sooner. However, in the case of many of the ports, the issue of landside access—the ports’ intermodal connectivity, the ease of international border crossing, and the port-city interface—is more important than the need to improve maritime access and capacity. The analysis finds that there is a need to improve the operating efficiency in all of the ESA ports, as they are currently less than half as productive as the most efficient ports in the matched data set of similar ports across the world, in terms of efficiency in container-handling operations. Similarly, there is a need to improve and formalize stakeholder engagement in many of the ports, to introduce modern management systems, and to strengthen the institutional framework to ensure the most efficient use of the infrastructure and to be able to attract private capital and specialist terminal operators. Finally, given the ports’ geographic location and proximity to main shipping routes, available draft, and the ongoing port-and-hinterland development, the book concludes that Durban and Djibouti are the most likely to emerge as the regional hubs in ESA’s future hub-and-spoke system.

In this report looking at policy for improving road and rail access to ports, the Transport Committee urges the Department for Transport (DfT) to become a keener advocate for UK ports. The Government should contribute to significant improvements to strategic networks which also deliver wider benefits - rather than simply expect port operators to pick up the entire bill for measures required to mitigate increased traffic due to port expansion. If the Government chooses to apply European Commission state aid rules in this area more strictly than other EU countries it should explain why it does so. Policy in this area should be applied consistently across the country. While some ports have contributed towards transport schemes to improve access, others have not and the differences in approach have not been explained or justified. Ports should also continue to contribute to local transport infrastructure improvements, following discussions with relevant local bodies. The Department for Transport should demonstrate whether port master plans have had any impact, highlighting good examples of such plans and of how they have influenced decision makers. Finally, the Government should devise a more effective successor to the Waterborne Freight Grant, to stimulate coastal shipping.

The National Policy Statement on National Networks, published in draft for consultation (ISBN 9780108560071), sets out the policy against which decisions will be made on applications for development consent for nationally significant infrastructure projects on the strategic road and rail networks. The Committee has a number of detailed recommendations to improve the draft. The NPS should specify more types of transport scheme which the Government thinks are needed, such as enhancements to the rail network to promote east-west connectivity; better road and rail connections to ports and airports and to parts of the country which are currently not well served by those networks; and schemes to promote regional economic development. Criticisms of the DfT's road and rail demand forecasts should be addressed. Estimates of the impact on UK carbon emissions of building more road infrastructure are needed. Adverse impacts of major transport schemes on localities should be set out. The NPS should make explicit reference to the desirability of connecting HS2 to the classic rail network. Promoters of roads schemes must look to improve road safety (including for cyclists and pedestrians). The Government is seeking to accommodate increasing demand for roads by building more infrastructure rather than seeking to manage demand. Investment in the road network will require new funding streams, a challenge that must be addressed. However, a consensus would be required to introduce any road user charging scheme across the strategic road network as an alternative to road taxation.
