The Ontario Education Development Charges Program provides an eligible school board with the option of imposing education development charges (EDCs) on residential & non-residential development. These guidelines are provided for facilitating the administration of the Program, beginning with guidance on how to complete an EDC background study. Such a study provides information on the methodology used by the board in determining the calculation of the charge, as well as the assumptions & logic employed in determining development projections, enrollment projections, site requirements, and estimated education land costs. This is followed by information on passing an EDC by-law, the role of the municipality in EDC collection & reporting, appeals to the by-law, and amendments to existing by-laws.

A review of the shortcomings of the DCA leads to a recommendation that the DCA be replaced by a new development charges section in the Municipal Act and City of Toronto Act that would enhance municipal efficiency, equity, and accountability, and ensure growth really does pay its own way. R epeal the DCA and replace it with a section on DCs added to the Municipal Act and City of Toronto Act to consolidate municipal finance legislation and place DCs under the powers and flexibility generally afforded to municipalities by these acts.2 2. Ensure that this new DC section is created through meaningful [...] Deductions from growth-related capital costs in recognition of grants and other contributions Before a municipality can incorporate the cost of a capital work into the DC calculation, the DCA requires that the cost be reduced by the amount of any grant, subsidy, or other contribution made to or anticipated by the municipality for that capital work. [...] The only exception occurs if the contributor explicitly indicates, at the time the contribution is made, how the contribution is to be shared between existing and new development, in which case the growth-related and non-growth- related portions of the capital cost are reduced by the amounts of the contribution respectively designated for these portions. [...] By this time, a portion of the growth the capital work is intended to serve may have become existing development, reducing the amount by which the cost of the capital work can be recovered by DCs.

The purpose of this report is to identify and consider the impact of the application of development charges and to identify alternatives to using them to finance growth-related capital costs. The application of these charges was clarified with the passage of the 1989 Development Charges Act. Since this time the quantum of development charges has increased significantly to the point where they are $30,000 to $50,000 per single family home in high growth municipalities surrounding Toronto. This upward pressure on development charge revenue is a result of fiscal pressure that municipalities face due to reduction in funding from senior levels of government.

Development charges are imposed by local planning authorities on developers to pay for infrastructure necessitated by new development. This thesis evaluates development charges against efficiency and equity criteria, and concludes that despite their shortcomings, they are superior to their alternatives. It also concludes that development charges should approximate marginal costs, and discusses possible techniques to achieve this goal. The thesis proceeds to evaluate the legal status of development charges in Israel and Ontario. In Ontario, new by-laws under the 'Development Charges Act' of 1997 are being developed, but municipalities may impose uniform charges within their area, without regard for the effect of location, type and density of development on the actual costs. These are likely to result in inefficiencies and perverse allocation of costs. In Israel, existing tools for raising revenue for infrastructure are generally inadequate and less equitable than development charges, and the thesis recommends that they be authorized instead.
