Reconsidering Constitutional Formation I National Sovereignty written by Ulrike Müßig and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-08-18 with Law categories.

This open access book can be downloaded from link.springer.com Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics. Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be ‘believed’ by the subjects and the political élites. Such a communicative orientation of constitutional processes became palpable in the ‘religious’ affinities of the constitutional preambles. They were held as ‘creeds’ of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents’ big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the ‘renaissance’ of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law. Therefore ReConFort will continue with the precedence of constitution. (www.reconfort.eu)

Spanish Identity In The Age Of Nations written by José Álvarez Junco and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-11 with categories.

Spanish identity in the age of nations offers the first comprehensive account in any language of the formation and development of Spanish national identity from ancient times to the present. Much has been written on French, British and German nationalism, but remarkably little has been published on Spanish nationalism. Paradoxically, even in Spain there is much more on Basque, Catalan and other regional nationalisms than on Spanish identity. As a result, this study fills an enormous gap in the literature on Spanish history. This book traces the emergence and evolution of an initial collective identity within the Iberian Peninsula from the Middle Ages to the end of the ancien regime based on the Catholic religion, loyalty to the Crown and Empire. The adaptation of this identity to the modern era, beginning with the Napoleonic Wars and the liberal revolutions, forms the crux of this study. None the less, the book also embraces the highly contested evolution of the national identity in the twentieth century, including both the Civil War and the Franco Dictatorship. Álvarez-Junco ́s pioneering study was awarded both the National Prize for Literature in Spain and the Fastenrath Prize by the Spanish Royal Academy

Myths Of Harmony written by Marixa Lasso and has been published by University of Pittsburgh Pre this book supported file pdf, txt, epub, kindle and other format this book has been release on 2007-08-12 with History categories.

This book centers on a foundational moment for Latin American racial constructs. While most contemporary scholarship has focused the explanation for racial tolerance-or its lack-in the colonial period, Marixa Lasso argues that the key to understanding the origins of modern race relations are to be found later, in the Age of Revolution.Lasso rejects the common assumption that subalterns were passive and alienated from Creole-led patriot movements, and instead demonstrates that during Colombia's revolution, free blacks and mulattos (pardos) actively joined and occasionally even led the cause to overthrow the Spanish colonial government. As part of their platform, patriots declared legal racial equality for all citizens, and promulgated an ideology of harmony and fraternity for Colombians of all colors. The fact that blacks were mentioned as equals in the discourse of the revolution and later served in republican government posts was a radical political departure. These factors were instrumental in constructing a powerful myth of racial equality-a myth that would fuel revolutionary activity throughout Latin America. Thus emerged a historical paradox central to Latin American nation-building: the coexistence of the principle of racial equality with actual racism at the very inception of the republic. Ironically, the discourse of equality meant that grievances of racial discrimination were construed as unpatriotic and divisive acts-in its most extreme form, blacks were accused of preparing a race war. Lasso's work brings much-needed attention to the important role of the anticolonial struggles in shaping the nature of contemporary race relations and racial identities in Latin America.

Abortion And Democracy written by Barbara Sutton and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2021-08-05 with Social Science categories.

Abortion and Democracy offers critical analyses of abortion politics in Latin America’s Southern Cone, with lessons and insights of wider significance. Drawing on the region’s recent history of military dictatorship and democratic transition, this edited volume explores how abortion rights demands fit with current democratic agendas. With a focus on Argentina, Chile, and Uruguay, the book’s contributors delve into the complex reality of abortion through the examination of the discourses, strategies, successes, and challenges of abortion rights movements. Assembling a multiplicity of voices and experiences, the contributions illuminate key dimensions of abortion rights struggles: health aspects, litigation efforts, legislative debates, party politics, digital strategies, grassroots mobilization, coalition-building, affective and artistic components, and movement-countermovement dynamics. The book takes an approach that is sensitive to social inequalities and to the transnational aspects of abortion rights struggles in each country. It bridges different scales of analysis, from abortion experiences at the micro level of the clinic or the home to the macro sociopolitical and cultural forces that shape individual lives. This is an important intervention suitable for students and scholars of abortion politics, democracy in Latin America, gender and sexuality, and women’s rights.
