Inhaltsangabe:Einleitung: In den letzten Jahren führten offensichtliche Kontrollschwächen und Überwachungsmängel zur Kritik am System: "Vorstand/Aufsichtsrat/Abschlußprüfer." Durch Einführung des KonTraG soll dieses vielschichtige Kontroll- und Überwachungssystem des (Versicherungs)Unternehmens gestärkt werden. Das KonTraG zielt darauf ab, das deutsche Unternehmensrecht zu modernisieren und stärker als bisher auf den internationalen Kapitalmarkt auszurichten. Hierbei ist es auch eine Art Gegenpol zur wachsenden Dominanz der "Shareholder Value Orientierung", d.h. der Optimierung des Kapitaleinsatzes deutscher Versicherungsunternehmen, da die Wahrnehmung von entsprechenden Chancen auch Risiken in sich trägt. Gang der Untersuchung: In dieser Arbeit wird untersucht, welche Bedeutung das KonTraG im einzelnen für das Gebiet des Risikomanagements von Versicherungsunternehmen in Deutschland hat. Es wird der Frage nachgegangen, inwieweit neben der Versicherungsaktiengesellschaft das öffentlich-rechtliche Versicherungsunternehmen und der Versicherungsverein auf Gegenseitigkeit von diesen neuen Vorschriften erfaßt werden. Es werden Möglichkeiten erläutert, wie ein Risikomanagementsystem aufgebaut werden kann und welche Anforderungen das KonTraG an solche Systeme stellt.
