Bachelorarbeit aus dem Jahr 2015 im Fachbereich BWL - Rechnungswesen, Bilanzierung, Steuern, Note: 1,1, Hochschule für Wirtschaft und Recht Berlin (Wirtschaftswissenschaften), Sprache: Deutsch, Abstract: Durch die EU-Verordnung Nr. 1606/2002 vom 19.07.2002 wurde bekannt, dass kapitalmarktorientierte Unternehmen ab dem 01.01.2005 ihren Konzernabschluss nach den International Financial Reporting Standards aufstellen müssen. Die Erstellung nach IFRS, soll die Harmonisierung von Unternehmen im globalen Kontext fördern, sodass eine Standardisierung, Transparenz und Vergleichbarkeit zwischen Abschlüssen geschaffen wird und eine Zeit- und Kostenersparnis für das zu erstellende Unternehmen entsteht. Zu beachten ist, dass nur der Konzernabschluss nach IFRS für kapitalmarktorientierte Unternehmen zu erstellen ist und nicht der Jahresabschluss selbst. Alle inländischen Unternehmen eines Konzerns müssen nämlich ihren Jahresabschluss nach Vorschriften des §§ 238 ff. HGB aufstellen; Ausnahmen bestehen für Einzelkaufleute nach § 241 a HGB. Dieser Jahresabschluss nach HGB der jeweiligen Unternehmen, ist für die Erstellung der Steuerbilanz bzw. der steuerlichen Gewinnermittlung maßgeblich nach § 5 (1) EStG. Dadurch, dass die laufenden Ertragsteuern aus der Steuerbilanz ermittelt werden, stehen die Ertragsteuern in der IFRS-Bilanz in keiner sinnvollen Relation zum Ergebnis nach IFRS. Zudem sind die Adressaten und die Zielsetzung von IFRS-Bilanz und Steuerbilanz verschieden. Die IFRS-Bilanz dient in erster Linie der Informationsvermittlung an Abschlussadressaten des jeweiligen Konzernabschlusses, wohingegen die Steuerbilanz dem Fiskus als Grundlage für die Besteuerung dient. Wie bei den Zielsetzungen, verfolgen beide Rechenwerke abweichende Bilanzierungs- und Bewertungsvorschriften, wodurch es zu einer Diskrepanz zwischen steuerrechtlicher Einkommensermittlung und Bilanzierung im Einzel- bzw. Konzernabschluss kommt. Diese Diskrepanzen bilden zugleich die Ursache und Notwendigkeit von latenten Steuern. Damit eine sinnvolle Relation zwischen dem IFRS-Ergebnis und den ausgewiesenen Ertragsteuern hergestellt und das oberste Gebot der Informationsvermittlung an den Abschlussadressaten bewahrt wird, werden latente Steuerabgrenzungsposten im Konzernabschluss nach IFRS gebildet.

The permanent establishment (PE) is a legal form of cross-border direct investment whereby a business presence is maintained as an integral part of the foreign investor. Due to the growing intensity and complexity of international business relations, the PE defi¬nition and the allocation of profi¬ts between head units and PEs have become highly contentious, especially from the perspectives of the major emerging economies of the BRIC countries (Brazil, Russia, India, and China). Unsurprisingly, the potential for tax avoidance and the scrutiny of tax authorities have increased enormously. Against this background, this work illustrates and compares the OECD Model Tax Convention with country-specifi¬c source taxation rules, focusing on possible tax system changes and offering reform proposals. Emphasizing the taxable implications of the various rules upon country-speci¬fic PE concepts, the author’s treatment covers such issues and topics as the following: – the PE de¬finition of the OECD MC and from the perspective of selected countries; – allocation of business pro¬fits under the Authorised OECD Approach (AOA); – avoidance of PE status; – implementation of a service PE proposal; – construction site PEs established by subcontractors; – existence of an agency PE; and – the OECD project on Base Erosion and Profi¬t Shifting (BEPS). The author uses simulated cross-border national and treaty cases to highlight qualifi¬cation conflicts, thus reinforcing his detailed discussion of source taxation rules of business profi¬ts and relevant case law in Germany, the United States, and the BRIC states. There is also a checklist detailing how companies can avoid unintentionally setting up a PE. The author’s deeply informed proposals provide much-needed guiding tax criteria and open the way to greater feasibility and transparency in PE taxation. Ever since Adam Smith, economists have been preoccupied with the puzzle of economic growth. The standard mainstream models of economic growth were and often still are based either on assumptions of diminishing returns on capital with technological innovation or on endogenous dynamics combined with a corresponding technological and institutional setting. An alternative model of economic growth emerged from the Cambridge School of Keynesian economists in the 1950s and 1960s. This model - developed mainly by Luigi Pasinetti - emphasizes the importance of demand, human learning and the growth dynamics of industrial systems. Finally, in the past decade, new mainstream models have emerged incorporating technology or demand-based structural change and extending the notion of balanced growth. This collection of essays reassesses Pasinetti's theory of structural dynamics in the context of these recent developments, with contributions from economists writing in both the mainstream and the Cambridge Keynesian traditions and including Luigi Pasinetti, William Baumol, Geoffrey Harcourt and Nobel laureate Robert Solow.
