Dominik Regelsberger setzt sich mit den bislang vertretenen Meinungen kritisch auseinander und stellt fest, dass diese Ansichten zum einen dogmatische Schwachen aufweisen und zum anderen zu uneinheitlichen und systematisch fragwurdigen Ergebnissen fuhren. Er erarbeitet einen neuen Ansatz, bei dem er neben gesellschaftsrechtlichen Aspekten das familiare Verhaltnis zwischen dem Vermieter und der Bedarfsperson als entscheidendes Merkmal heranzieht. Die aus der Anwendung dieser Losung resultierenden Ergebnisse stellt der Verfasser anhand einiger Beispiele aus der Praxis dar.
