November 1918 war das Ende der Monarchie in Deutschland besiegelt. Eine neue Staatsform sollte her, die Demokratie. Mit dem Entwurf der künftigen Verfassungsordnung wurde der bis dato wenig bekannte Jurist und Landtagsabgeordnete der DDP, Hugo Preuß, beauftragt. Als linksliberaler Publizist und Jude gehörte Preuß eher zu den Außenseitern des Reiches, umso verwunderlicher ist daher seine Ernennung zum Staatssekretär des Inneren am 15. November. Hier schuf er innerhalb von nur drei Wochen einen ersten Entwurf der Reichsverfassung. Doch in Hinblick auf das Scheitern der Weimarer Republik durch die Machtübernahme der Nationalsozialisten am 30. Januar 1933 erscheint auch Hugo Preuß als "Vater" der Reichsverfassung in einem schlechten Licht. So bleiben vor allem scheinbare konzeptionelle Mängel der Reichsverfassung, wie das instabile Verhältniswahlrecht oder die starke Stellung des Reichspräsidenten, in Erinnerung. In meiner Hausarbeit beschäftige ich mich daher mit der Frage, ob man Hugo Preuß als Wegbereiter einer modernen parlamentarischen Demokratie bezeichnen kann. Wie sehr plädierte er in seinem Entwurf für ein parlamentarisches System? Wie sollte dieses aussehen? Um dies zu beantworten, werde ich zunächst auf Preuß' grundlegendes methodisches Staatsdenken eingehen, welches vor allem von der Genossenschaftslehre Otto von Gierkes beeinflusst wurde. Dies ist wichtig, um Preuß' Staatstheorie zu verstehen, vor allem bei seiner Haltung zum Souveränitätsbegriff und der Partizipation des Volkes am Staat. Den Schwerpunkt meiner Untersuchung lege ich dabei auf die oberen Reichsorgane. Insbesondere auf das Verhältnis zwischen Staatsoberhaupt, Regierungschef und Parlament, welches entscheidend für das Verständnis seiner Parlamentarismustheorie ist. Ein Hauptaugenmerk werde ich hierbei auf Preuß' ersten Verfassungsentwurf aus der "Denkschrift zum Entwurf des allgemeinen Teils der Reichsverfassung vom 3. Januar 1919" legen.

THE FIRST GERMAN edition of this book appeared in 1940. Since then the book has gone through five more editions and has been translated into Spanish and Italian. The present English translation is based on the sixth German edition. The author was Professor of Economics at the University of Freiburg, Germany. Professor Eucken was a student at a time when the Historical School dominated the teaching of econo mics at the German universities. Although, at the beginning of his career, he did some work along the lines of the Historical School, neither the ~ims nor the methods of historical research the field of economics as practised by the representatives in of the Historical School satisfied him; and the fact that the members of this school were unable to explain the causes of economic events such as the German inflation after World War I was an added reason for him to turn to economic theory. He became, among German economists, the foremost opponent of the Historical School, which he criticised in several publica tions. Through his wrItings and his teaching he contributed his share to the revival of interest in economic theory which was noticeable in the 'twenties. And he was one of the few economists left in Germany who helped to keep this interest alive during the 'thirties and during World War II. During this time he published Kapitaltheoretische Untersuchungen (1936), and the present volume, which immediately gave rise to an extensive discussion in German economic journals.
