Masterarbeit aus dem Jahr 2010 im Fachbereich Soziale Arbeit / Sozialarbeit, Note: 2,0, Universität Duisburg-Essen, Sprache: Deutsch, Abstract: Anders als in der gewinnorientierten Wirtschaft, ist im Sozialwesen häufig nicht die Einkommensproduktion zentrales Element, sondern eine Idee von Hilfe, Unterstützung, Gerechtigkeit oder Chancengleichheit. Um einer solchen Idee Gestaltungsspielraum zu verschaffen, hat sich in der Gesellschaft eine Reihe von Rechtsformen herausgebildet, die steuerlich begünstigt werden, wenn sie die Auflagen und Kriterien der Gemeinnützigkeit erfüllen. Damit reagiert das Gemeinwesen auf seinen Bedarf an unterstützenden Strukturen und ermöglicht diesen häufig erst die Existenz, durch Entlastung, oder sogar direkte Förderung. Die in Deutschland bekannteste Rechtsform zur Organisation ehrenamtlichen Engagements ist der eingetragene Verein. In den letzten Jahrzehnten hat sich der dritte Sektor, die Wohlfahrtsverbände und Nonprofit-Unternehmen, jedoch weit ausgedehnt. Als Erbringer nahezu aller sozialstaatlichen Leistungen, ist er darüber hinaus in seiner Gesamtheit zu einem der größten Arbeitgeber der Republik avanciert. Die Sozialwirtschaft wird getragen von Dienstleistungsunternehmen, die zwar nach wie vor gemeinnützige Ziele verfolgen, aber mit Umsatz und Personalmasse durchaus mit gewinnorientierten Unternehmen konkurrieren können. Für solche Organisationen ist der Verein keine adäquate Rechtsform mehr. Stattdessen erlaubt das deutsche Steuerrecht auch Kapitalgesellschaften, den Status der Gemeinnützigkeit zu erreichen, die häufig wesentlich besser zur Führung wirtschaftsnaher Unternehmen geeignet sind. Während dabei die gemeinnützige Aktiengesellschaft eher selten vertreten ist, tritt die gemeinnützige Gesellschaft mit beschränkter Haftung immer häufiger in Erscheinung. Die vorliegende Arbeit versucht diesem Tatbestand Rechnung zu tragen, indem sie ein möglichst genaues Bild der Rechtsform „gem. GmbH“ zeichnet und ihre Vor- und Nachteile gegenüber dem eingetragenen Verein formuliert und abwägt. Andere Rechtsformen, wie die bereits erwähnte gemeinnützige AG, oder auch die Genossenschaft, werden aufgrund ihrer Unterrepräsentanz nicht berücksichtigt. Lediglich auf die Eigenschaften von Stiftungen wird kurz Bezug genommen, da diese häufig als Gesellschafter von gemeinnützigen GmbHs in Erscheinung treten.

An investigation into the use of information communication technologies by refugees during flight, displacement and in settlement, this book examines the impact of Australia’s official policy of mandatory detention on how asylum seekers and refugees maintain links to diasporas and networks of support. Given the restricted contact with the world outside of the immigration detention centre, the book juxtaposes forms and processes of technology-mediated communication between institutionalised detention, with those of displacement and settlement. It finds that while there are obstacles to communication in situations of conflict and dislocation, asylum seekers and refugees are able to ‘make do’ with the technology options available to them in ways which were less constrained than in detention settings. The book also outlines how communication practices during the settlement process focus on learning new technologies, and repairing the disconnections with family members resulting from separation and detention.
