Die Arbeit behandelt am Beispiel der Verfahren gegen ehemalige Angehörige der Sicherheitspolizei für den Bezirk Bialystok die Strafverfolgung von NS-Verbrechen durch die westdeutsche Justiz. Die Organisation der Deportationen im Jahr 1943 aus den jüdischen Ghettos des deutsch besetzten nordostpolnischen Bezirks in die Vernichtungslager Auschwitz und Treblinka war Gegenstand eines Strafprozesses vor dem Schwurgericht in Bielefeld. Die Angeklagten wurden am 14. April 1967 wegen ihrer Beteiligung an den Deportationen aus Bialystok und Grodno der "gemeinschaftlichen Beihilfe zum gemeinschaftlichen Mord" an mehreren tausend Juden schuldig gesprochen. Der ehemalige Kommandeur der Sicherheitspolizei und ein Abteilungsleiter seiner Dienststelle wurden in einem weiteren Fall wegen Beihilfe zum Mord verurteilt. Das Gericht erbrachte den Nachweis, dass sie im Februar 1943 die Erschießung von 100 Bialystoker Juden veranlasst hatten. Anhand dieser Verbrechen werden - vor dem Hintergrund rechtsphilosophischer und rechtsdogmatischer Ansätze und auf der Grundlage von Tonbandmitschnitten der Hauptverhandlung - die Logik der juristischen Aufklärung und die gerichtliche Wirklichkeitsrekonstruktion im Verhältnis zur forensischen Interaktionsdynamik analysiert.

Ausgangspunkt dieses Buches ist die Frage, inwieweit Wissen objektiv begründbar ist und inwieweit unsere Aussagen in ihrem Anspruch als wahr zu gelten, einen Bezug zu einer unabhängig von unserem subjektiven Erleben gegebenen Welt notwendig voraussetzen müssen. Insgesamt soll gezeigt werden, dass erstens jeder Wahrheitstheorie korrespondenztheoretische Annahmen (d.h. Wahrheit ist Übereinstimmung einer Aussage bzw. eines Gedankens mit der Wirklichkeit) in irgendeiner Weise zugrundeliegen müssen. Zweitens dass jedoch jede Form der Korrespondenztheorie notwendig entweder zu in sich widersprüchlichen Systemen führt (v.a. Kant, Fichte, Hegel, Aristoteles und Popper) oder zu sich abkapselnden Doktrinen, die per se nicht falsifizierbar sind (Thomas von Aquin, die Stoiker, Platon, Wittgenstein, Habermas). Schlussfolgerung: Da jede Erkenntnistheorie korrespondenztheoretische Grundannahmen beinhalten muss (z.B. der ontologische Grundsatz einer Entsprechung von Sein und Bewusstsein), liegt in ihnen stets eine Erklärungslücke vor.
