Seit Einführung der Sektorregulierung unterliegen Strom- und Gasnetzentgelte einer regulierungsbehördlichen Vorabkontrolle. Aufgrund ihrer in aller Regel sehr starken Marktposition kommen die Betreiber von Strom- oder Gasnetzen daneben auch als Adressaten des kartellrechtlichen Missbrauchsverbots in Betracht. Eine parallele Anwendung von Kartell- und Regulierungsrecht birgt allerdings die Gefahr widersprüchlicher Entscheidungen, etwa wegen Zielkonflikten der Rechtsmaterien. Johann Ante geht vor diesem Hintergrund der Frage nach, ob eine kartellrechtliche Kontrolle der Energienetzentgelte trotz bestehender Entgeltregulierung möglich ist. Dabei untersucht er sowohl die Anwendbarkeit des deutschen als auch des europäischen Kartellrechts. Daneben werden prozessuale Fragen zur Darlegungs- und Beweislast im Kartellzivilprozess wegen vermeintlich missbräuchlicher Energienetzentgelte behandelt.
