Die Kommunikations- und Informationstechnik hat durch ihre revolutionäre Entwicklung in den letzten Jahren dazu geführt, daß der Schritt in das 21. Jahrhundert einem Sprung in eine neue Gesellschaftsform gleichkommt - der Informationsgesellschaft. Der Autor erörtert zu Beginn die technischen und wirtschaftlichen Zusammenhänge dieser Informationsgesellschaft und zeigt mögliche Anknüpfungspunkte für zukünftige Regelungen auf.Den durch den Umbruch in der Kommunikation ausgelösten verstärkten Regelungsaktivitäten der Europäischen Gemeinschaft stehen in der Bundesrepublik erhebliche Zweifel an den Kompetenzen der Gemeinschaft gegenüber. Dieses Spannungsverhältnis wird dadurch weiter zugespitzt, daß das von der Gemeinschaft angestrebte einheitliche Kommunikationsrecht Rundfunk und Telekommunikation zusammenführen soll. Im Hinblick auf die daraus resultierende Kompetenzfrage für den rechtlichen Rahmen der Informationsgesellschaft entwickelt der Autor eine Prüfungssystematik, mit deren Hilfe die zukünftigen Gemeinschaftsmaßnahmen gemessen werden können. Ausgehend von der Grundsatznorm des Art. 3b EGV wird für den Rundfunk und die Telekommunikation unter besonderer Berücksichtigung der neuen Dienste geklärt, wie die Kompetenzen zwischen der Gemeinschaft und ihren Mitgliedstaaten verteilt sind. Sodann werden die Kompetenzausübungsgrundsätze der Subsidiarität und der Verhältnismäßigkeit herangezogen, um in klar voneinander abgegrenzten Prüfungsschritten die Frage zu beantworten, ob und in welchem Ausmaß die Gemeinschaft die ihr übertragenen Kompetenzen auszuüben vermag. Schließlich erfordert das Maastricht-Urteil des Bundesverfassungsgerichts eine Prüfung, wer für die Entscheidung der drohenden Kompetenzkonflikte zuständig ist und wie dabei zu verfahren ist. Dabei wird wiederum zwischen Kompetenzverteilung und -ausübung differenziert.Nach der Behandlung der grundsätzlichen Kompetenzproblematik schließt Rosenthal die Arbeit mit der Erörterung der bereits bestehenden und der angestrebten Regelungen der Kommunikation auf europäischer Ebene.

The ever increasing relevance of European law which involves replacement or supplementation of and interaction with national law not only affects the states in Europe but also, and foremost, the citizens. The rights of the citizens in Europe are protected by the European Fundamental Rights and Freedoms. The aim of this textbook is to grasp and illustrate the meaning of these rights and to integrate it into a coherent system. For this purpose the book not only deals with the pertinent law of the European Union and the European Community, but also with the European Convention for the Protection of Human Rights and Fundamental Freedoms which, too, is becoming more and more important. In addition, regard is had to the Charter of Fundamental Rights of the Union which forms part of the Treaty establishing a Constitution for Europe. Although the Charter is not yet legally binding since the Constitution has not been ratified by all EU Member States, the Community Courts already make reference to it as a concentrate of the constitutional traditions common to the Member States. It therefore does not seem entirely unlikely that the Charter might be included into the existing Treaties irrespective of the future constitutional developments on the EU level. On a similar anticipatory basis the book also takes into account those Protocols to the European Convention for the Protection of Human Rights and Fundamental Freedoms that have not yet entered into force.

The development of EU enlargement has raised many thorny issues unanticipated by the framers of the EC Treaty. A significant upshot of these issues is that the concept of European identity – defined in terms of such factors as culture, history and economics – has supplanted the long-dominant theme of ‘widening and deepening,’ particularly since the Union’s expansion has become primarily eastward. The major contribution of this important book lies in its analysis of the conceptualization and perception of enlargement from various points of view, focusing on the concerns of stakeholders and the ‘identity’ conflicts and uncertainties incurred by enlargement initiatives. In the course of its presentation, it details the actual pre-accession Europeanization process and its complex history. Among the key elements discussed are the following: the conflict between ‘widening’ and ‘deepening’ and the effect on EU institutional reform; institutional requirements on candidate countries; pre-accession criteria and negotiations; administrative capacity, judicial capacity, and legal approximation in accession states; capacity of the EU to absorb new Member States; and EC law as part of European identity.
