Die Arbeit behandelt aus rechtsvergleichender und interdisziplinarer Perspektive die Frage nach dem Sinn und Zweck des Erbrechts und seiner Ausgestaltung. Anlass sind Vermogensbindungsmechanismen, die es dem Einzelnen zunehmend gestatten, sein Vermogen dem Erbrecht zu entziehen: Die privatnutzige Stiftung in Deutschland, Osterreich, Liechtenstein und in einer wachsenden Zahl weiterer kontinentaler Rechtsordnungen, aber auch der dynastic trust in den Vereinigten Staaten und zahlreichen offshore-Jurisdiktionen ermoglichen es dem Vermogensinhaber, sein Vermogen generationenubergreifend eigenen Regeln - einem privaten Erbrecht - zu unterwerfen. Diese Mechanismen unterscheiden sich im Ergebnis kaum von langst uberwunden geglaubten Rechtsinstituten wie dem deutschen Familienfideikommiss oder dem entail des common law. Anatol Dutta untersucht, ob das Erbrecht (einschliesslich des Erbschaftsteuerrechts) heute noch Funktionen in Gesellschaft, Wirtschaft und Familie erfullen kann, und auf welche Weise diese Funktionen durch Grenzen einer generationenubergreifenden Vermogensbindung geschutzt werden konnen.

Die Kernpunkte der modernen Arbeitsorganisation werden adäquat auf die familiale Lebensführung fokussiert. So zeigt die Arbeit die Vereinbarkeitsprobleme zwischen Arbeit und Familie auf, die in der öffentlichen Diskussion bislang nur auf die Hausfrauendebatte und nicht ausreichende Kinderbetreuungskapazitäten zurückgeführt wurden. Veränderte Arbeitsbeziehungen zwischen den Arbeitsmarktakteuren hingegen sind nicht umfassend berücksichtigt worden, die aber maßgebend sind, weil Spontaneität und Flexibilität in der Erwerbsphäre mit der Verlässlichkeit der Familie kollidieren. Bislang gibt es nur wenig Stoff über diese Kombination. Ich versuche, die kapitalistische Dynamik für die heute schwierigen Bedingungen, die Familien in ihrem Alltag haben, verantwortlich zu machen. Das Thema ist hoch aktuell, die Arbeit hat eine relativ gute Note erzielt und ist dabei kostengünstig. Sie eignet sich als guter Leitfaden für andere Diplomarbeiten o.ä.

In Creating Cooperation, Pepper D. Culpepper explains the successes and failures of human capital reforms adopted by the French and German governments in the 1990s. Employers and employees both stand to gain from corporate investment in worker skills, but uncertainty and mutual distrust among companies doom many policy initiatives to failure. Higher skills benefit society as a whole, so national governments want to foster them. However, business firms often will not invest in training that makes their workers more attractive to other employers, even though they would prefer having better-skilled workers.Culpepper sees in European training programs a challenge typical of contemporary problems of public policy: success increasingly depends on the ability of governments to convince private actors to cooperate with each other. In the United States as in Europe, he argues, policy-makers can achieve this goal only by incorporating the insights of private information into public policy. Culpepper demonstrates that the lessons of decentralized cooperation extend to industrial and environmental policies. In the final chapter, he examines regional innovation programs in the United Kingdom and the clean-up of the Chesapeake Bay in the United States—a domestic problem that required the coordination of disparate agencies and stakeholders.
