Gerade in Zeiten, da viele Menschen über immer kleinere Einkommen verfügen, wird deshalb die Finanzierung der Kirchen in Frage gestellt. Insbesondere der Punkt der Gerechtigkeit dieser Abgabe ist dabei von Relevanz. In den letzen Jahren kam es zu einer erheblichen Zahl an Kirchenaustritten, da sich die Einen in einer ohnehin prekären finanziellen Situation zusätzlich belastet sehen und Andere über unverhältnismäßig hohe Abgaben klagen, die ihrem Empfinden von Gerechtigkeit nicht entsprechen. Zudem gibt es auch eine Reihe von Menschen, die die Kirchensteuer als solche in Frage stellen und nicht an deren rechtliche Legitimität glauben. Sind dies nur Vorurteile, die aus einem Mangel an Information entstehen oder sind die Vermutungen richtig, dass es dem deutschen Kirchensteuersystem an Legitimität und Gerechtigkeit mangelt? In dieser Arbeit soll genau dieser Frage nachgegangen und geprüft werden, ob die Kirchensteuer in Deutschland auf einer soliden rechtlichen Basis steht und wo eventuelle Mängel bei der praktischen Umsetzung er rechtlichen Vorgaben bestehen. Ziel ist es dabei, zunächst die Frage nach der Legitimität zu beantworten und darauf aufbauend zu zeigen, dass es eine Reihe an Verbesserungsmöglichkeiten hinsichtlich eines gerechteren Systems gibt. Um einen Einstieg in die Thematik zu gewährleisten und grundlegende Informationen zu geben ist es unerlässlich, zu Beginn die historische Entwicklung des deutschen Kirchensteuersystems darzustellen. Dies dient nicht zuletzt dem Verständnis der rechtlichen Gegebenheiten. Bei dieser Betrachtung soll aber auch auf den Nutzen und die Sinnhaftigkeit der derzeitigen Praxis eingegangen werden.
