English summary: In the case of traffic accidents and other incidents which cause damage, the injured party often shares responsibility for the damage. However up to now it has not been quite clear what the dogmatic basis for dealing with this problem is. Dirk Looschelders deals with contributory negligence of the injured party on the basis of comparative law. In general, negligence pertains to illegal conduct; however it is not illegal to contribute to damage to oneself. On the basis of his own dogmatic deliberations, the author examines the factual prerequisites for contributory negligence of the injured party in accordance with 254 of the BGB (Civil Code). He concludes his book with a detailed discussion of the general principles for allocating the damage to the party that caused the damage and the injured party.

Die Struktur Des Haftungsrechts written by Nils Jansen and has been published by Mohr Siebeck this book supported file pdf, txt, epub, kindle and other format this book has been release on 2003 with Law categories.

English summary: Nils Jansen offers a theoretical and historical foundation aiming at a better understanding of the present tort law. He analyzes the normative structure of tort liability in terms of distributive or corrective justice and individual responsibility, asking whether the basic concepts really suit their function in actual decisions. He then reconstructs the history of the civil law of torts, showing that it evolved from the ancient Roman law of delict which originally was not related to the reparation of damage. On the basis of his historical and theoretical analysis, he concludes this work by giving a doctrinal reconstruction of tort law leading up to a restatement of the present law.

The year 2018 will feature a number of key developments in shaping the digital single market. Whereas some issues are now in the final stages of the legislative process, other key topics are in their infancy and therefore, in line with the objective of the Münster Colloquia on EU Law and the Digital Economy, require in-depth discussion as to how EU law should react to the challenges and needs of the digital economy. The 2018 Münster colloquium will focus on an issue central to the digital single market: The "Liability for Robotics and in the Internet of Things". The European legislator faces the challenge to decide between adapting existing product liability rules or the creation of new concept of objective liability for autonomous systems. This book deals with the rules that are in force in Europe for juvenile offenders. The aim of the rules is to uphold the rights and safety of juvenile offenders subject to sanctions or measures and to promote their physical, mental and social well-being when subject to community sanctions or measures, or any form of deprivation of liberty. It is based on Recommendation Rec(2008)11 of the Committee of Ministers of the Council of Europe on the European Rules for juvenile offenders subject to sanctions or measures, which was adopted on 5 November 2008. The first part of the book contains the text of the recommendation and is followed by a commentary which explains in finer detail the rules and the points raised by the text. The final section provides an analysis of the national replies to a questionnaire related to the treatment of juvenile offenders. This work will be of interest to human rights scholars, researchers and students of law, criminology and international relations.

A great deal of economics is about law - the functioning of markets, property rights and their enforcement, financial obligations, and so forth - yet these legal aspects are almost never addressed in the academic study of economics. Conversely, the study and practice of law entails a significant understanding of economics, yet the drafting and administration of laws often ignore economic principle. The New Palgrave Dictionary of Economics and the Law is uniquely placed by the quality, breadth and depth of its coverage to address this need for building bridges. Drawn from the ranks of academics, professional lawyers, and economists in eight countries, the 340 contributors include world experts in their fields. Among them are Nobel laureates in economics and eminent legal scholars. First published in 1998 and now available in paperback for the first time, The New Palgrave Dictionary of Economics and the Law has established itself as a classic reference work in this important field.

`A lucid, comprehensive analysis of normative approaches to international relations, and an original contribution to critical theory′ - Andrew Linklater, University of Keele `Hutchings combines a valuable account of the current state of the art with a lucid expositon of her own, highly distinctive, position. This will be required reading for students in international political theory, and indeed anyone interested in normative issues in international relations′ - Chris Brown, London School of Economics and Political Science Providing an invaluable overview of the competing schools of thought in traditional and contemporary international theory, this book seeks to path the way forward for new ways of thinking about international political morality. First, the role and place of normative theory in the study of international politics is explained before a discussion of mainstream approaches within international relations and applied ethics. Here the student is introduced to the central debates between realists and idealists, and cosmopolitans and communitarians. Second, the conceptual challenges of contemporary approaches in critical theory, postmodernism and feminism are outlined and then used as a platform to develop the author′s own Hegelian-Foucauldian approach for doing normative international theory. Third, the insights drawn from each approach are applied to the study of two key topics in contemporary theoretical debate: the right to self-determination, and the idea of cosmopolitan democracy, and conclusions drawn for transcending the theoretical deadlock in international relations. Accessibly written and wide-ranging, this text will quickly become essential reading for all students and academics of politics and international relations seeking a deeper understanding of the underlying tensions and future potential of international theory today.

Treaty Interpretation written by Richard K. Gardiner and has been published by Oxford University Press, USA this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015 with Law categories.

The rules of treaty interpretation codified in the 'Vienna Convention on the Law of Treaties' now apply to virtually all treaties, in an international context as well as within national legal systems, where treaties have an impact on a large and growing range of matters. The rules of treaty interpretation differ somewhat from typical rules for interpreting legal instruments and legislation within national legal systems. Lawyers, administrators, diplomats, and officials at international organisations are increasingly likely to encounter issues of treaty interpretation which require not only knowledge of the relevant rules of interpretation, but also how these rules have been, and are to be, applied in practice. Since the codified rules of treaty interpretation came into decree, there is a considerable body of case-law on their application. This case-law, combined with the history and analysis of the rules of treaty interpretation, provides a basis for understanding this most important task in the application of treaties internationally and within national systems of law. Any lawyer who ever has to consider international matters, and increasingly any lawyer whose work involves domestic legislation with any international connection, is at risk nowadays of encountering a treaty provision which requires interpretation, whether the treaty provision is explicitly in issue or is the source of the relevant domestic legislation. This fully updated new edition features case law from a broader range of jurisdictions, and an account of the work of the International Law Commission in its relation to interpretative declarations. This book provides a guide to interpreting treaties properly in accordance with the modern rules.

Why Worry About Future Generations written by Samuel Scheffler and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018 with Generations categories.

The things we do today may make life worse for future generations. But why should we care what happens to people who won't be born until after all of us are gone? Some philosophers have treated this as a question about our moral responsibilities, and have argued that we have duties of beneficence to promote the well-being of our descendants. Rather than focusing exclusively on issues of moral responsibility, Samuel Scheffler considers the broader question of why and how future generations matter to us. Although we lack a developed set of ideas about the value of human continuity, we are more invested in the fate of our descendants than we may realize. Implicit in our existing values and attachments are a variety of powerful reasons for wanting the chain of human generations to persist into the indefinite future under conditions conducive to human flourishing. This has implications for the way we think about problems like climate change. And it means that some of our strongest reasons for caring about the future of humanity depend not on our moral duty to promote the good but rather on our existing evaluative attachments and on our conservative disposition to preserve and sustain the things that we value. This form of conservatism supports rather than inhibits a concern for future generations, and it is an important component of the complex stance we take toward the temporal dimension of our lives.

Consumer Credit Debt And Bankruptcy written by Johanna Niemi and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2009-07-15 with Law categories.

After a long period of prosperity and steady economic growth, the world's leading economies are now in crisis, and although there will be debate about its origins, the scale and seriousness of the crisis is in no doubt. There is also no doubt that excessive amounts of consumer credit, allied to a weak understanding of how globalised credit markets might react to a crisis, have played a significant part. This book, which is primarily about credit, debt and the trouble they have led to, is written by authors who have specialised in researching into over-indebtedness, that is, situations in which an individual's debt burden has become overwhelming. For these authors the plight of individuals is a primary concern, but the wider issue is how credit is used and how it changes societies. The essays in this volume, addressing topics which are fundamental to our understanding of the current crisis, range widely across the whole sector of consumer finance, including mortgages, 'credit-binges', the regulation of consumer lending, insolvency, repayment plans, debt counselling and much more besides. The conclusions drawn from the book are equally wide-ranging, but above all the lesson learned from these essays is that the financialisation of contemporary life ensures that issues of the appropriate role of credit remain of critical importance in society.
