To anyone setting out to explore the entanglement of international criminal justice with the interests of States, Germany is a particularly curious, exemplary case. Although a liberal democracy since 1949, its political position has altered radically in the last 60 years. Starting from a position of harsh scepticism in the years following the Nuremberg Trials, and opening up to the rationales of international criminal justice only slowly - and then mainly in the context of domestic trials against functionaries of the former East German regime after 1990 - Germany is today one of the most active supporters of the International Criminal Court. The climax of this is its campaigning to make the ICC independent of the UN Security Council - a debate in which Germany took a position in stark contrast to the United States. This book offers new insight into the debates leading up to such policy shifts. Drawing on government documents and interviews with policymakers, it enriches a broader debate on the politics of international criminal justice which has to date often been focused primarily on the United States.

English summary: In this study, Frank Neubacher provides an interdisciplinary link between international law and criminal sciences and explains the process of setting and implementing standards in international criminal law. His methods are based on the labeling approach according to which delinquent behavior cannot be analyzed without referring to social interaction and social definitions that label a behavior as 'criminal' or refrain from doing so, as is often the case on the governmental level. The author comes to the conclusion that effective protection of human rights requires to broaden the concept of criminality in order to include the actions of the powerful and that there is no alternative to a functioning international criminal jurisdiction. German description: Mit seiner Studie leistet Frank Neubacher einen interdisziplinaren Bruckenschlag zwischen Volkerrecht und Kriminalwissenschaften, indem er u.a. den Prozess der Normgenese und Normimplementation im internationalen Strafrecht (Volkerstrafrecht) nachvollzieht. Methodisch stutzt er sich auf den labeling approach, wonach delinquentes Verhalten nicht ohne Bezug zu den gesellschaftlichen Interaktionen und Definitionen analysiert werden kann, die das Pradikat kriminell zuschreiben oder, wie auf der Ebene von Staatsfuhrungen deutlich wird, auch nicht zuschreiben. Der labeling-Ansatz wird jedoch, wo er heute nicht mehr uberzeugen kann, modifiziert, um zu einer unvoreingenommenen Analyse der Entwicklung des internationalen Strafrechts vorzustossen. Dadurch kann er mit atiologischen Fragestellungen kombiniert sowie fur die Frage geoffnet werden, inwieweit kriminologische Befunde eine internationale Strafgerichtsbarkeit legitimieren konnen. In diesem Zusammenhang geht der Autor u.a. auf empirische Erkenntnisse zur interkulturellen Schwereeinschatzung von Delikten, zur Viktimologie und zur individuellen strafrechtlichen Zurechnung von Systemunrecht ein. Er kommt zu dem Schluss, dass der wirksame Schutz von Menschenrechten eine Ausweitung des Kriminalitatsverstandnisses auf das Handeln von Regierenden und Machtigen erfordert und dass es zu einer funktionsfahigen internationalen Strafgerichtsbarkeit keine Alternative gibt.
