Die Arbeit stellt ausführlich die Entwicklung der Leitsätze, die den Unternehmen auferlegten Sorgfaltspflichten und das Beschwerdeverfahren bei den Nationalen Kontaktstellen dar. Anhand einer normativen und empirischen Analyse kommt die Autorin zu dem Ergebnis, dass die Leitsätze trotz ihrer nach wie vor ambivalenten Ausgestaltung eine zunehmende verhaltenssteuernde Wirkung entfalten. Dieser Wirkung kommt angesichts bisheriger Hürden bei der rechtlichen Regulierung und Haftbarmachung von Unternehmen für Menschenrechtsverletzungen eine besondere Bedeutung zu. Sie fordert das klassische Völkerrechtsverständnis heraus und wird mit der Bezeichnung »soft law« nur unzureichend charakterisiert. Die Autorin sieht die Leitsätze als Teil einer aktuellen Dynamik, die zu einer völker(gewohnheits)rechtlichen Verfestigung der unternehmerischen Verantwortung zum Respekt der Menschenrechte führen könnte.
