Die Grundfreiheiten bilden die Stützpfeiler der gemeinschaftsrechtlichen Wirtschaftsverfassung (Art. 2 EGV). Der EG-Vertrag unterscheidet zwischen Warenverkehrsfreiheit (Art. 23-31 EGV), Arbeitnehmerfreizügigkeit (Art. 39-42 EGV), Niederlassungsfreiheit (Art. 43-48 EGV), Dienstleistungsfreiheit (Art. 49-55 EGV) und Freiheit des Kapital- und Zahlungsverkehrs (Art. 56-60 EGV), die jeweils Teilbereiche von Wirtschaftsaktivitäten mit grenzüberschreitendem Bezug schützen. Die Warenverkehrsfreiheit verbietet Ein- und Ausfuhrbeschränkungen sowie Maßnahmen gleicher Wirkung und sichert somit den freien Warenhandel. Die Arbeitnehmerfreizügigkeit räumt den Unionsbürgern innerhalb der EG Einreise- und Aufenthaltsrechte im Zusammenhang mit der freien Wahl eines Arbeitsplatzes ein. Die Niederlassungsfreiheit bietet den Selbständigen die Möglichkeit ihren Unternehmensstandort frei, nach optimalen Standortfaktoren, zu wählen. Die Dienstleistungsfreiheit schützt sowohl Dienstleistungserbringer als auch –empfänger bei grenzüberschreitender Inanspruchnahme. Die Kapitalverkehrsfreiheit ermöglicht die grenzüberschreitende Transaktion von Geld und Anlagewerten. Die Zahlungsverkehrsfreiheit bezieht sich auf die Erfüllung von Verbindlichkeiten.

[European fundamental rights] European law is increasingly superseding and displacing national law. The ever increasing relevance of European law which involves replacement or supplementation of and interaction with national law not only affects the states in Europe but also, and foremost, the citizens. The rights of the citizens in Europe are protected by the European Fundamental Rights and Freedoms. The aim of this textbook is to grasp and illustrate the meaning of these rights and to integrate it into a coherent system. For this purpose the book not only deals with the pertinent law of the European Union and the European Community, but also with the European Convention for the Protection of Human Rights and Fundamental Freedoms which, too, is becoming more and more important. In addition, regard is had to the Charter of Fundamental Rights of the Union which forms part of the Treaty establishing a Constitution for Europe. Although the Charter is not yet legally binding since the Constitution has not been ratified by all EU Member States, the Community Courts already make reference to it as a concentrate of the constitutional traditions common to the Member States. It therefore does not seem entirely unlikely that the Charter might be included into the existing Treaties irrespective of the future constitutional developments on the EU level. On a similar anticipatory basis the book also takes into account those Protocols to the European Convention for the Protection of Human Rights and Fundamental Freedoms that have not yet entered into force.

Die Grundfreiheiten begrunden kein Recht auf allgemeine Wirtschaftsfreiheit. Das ist in der Theorie weitgehend unumstritten. Lars Klenk untersucht, ob diese Aussage auch bezuglich der Rechtsprechung des Gerichtshofs der Europaischen Union zutrifft. Er gelangt dabei zu einem ernuchternden Resultat: Ausgehend von der Judikatur des Gerichtshofs sind die Grundfreiheiten weitgehend grenzenlos. Es ist moglich, auf ihrer Grundlage in allen kostenverursachenden Regelungen der Mitgliedstaaten eine Beschrankung zu erblicken, welche der Gerichtshof sodann ausnahmslos einer luckenlosen Verhaltnismassigkeitskontrolle unterziehen kann. Dieser Befund beruht nicht auf der Abwesenheit tauglicher Ansatze fur eine hinreichend begrenzte Interpretation der Grundfreiheiten. Es ist vielmehr zu fragen, worin die Grunde fur den scheinbaren Widerwillen des Gerichtshofs liegen, sich einem dieser Ansatze anzuschliessen.
