Begriffe, welchen wir heute nicht mehr aus dem Weg gehen können. Begriffe, die allgegenwärtig sind, Begriffe, welche die Nachrichten im Fernsehen, in den Zeitungen oder im Radio prägen. Begriffe, die für viel mehr stehen als für bloße Institutionen oder Schlagwörter aus den letzten Monaten. Sie stehen für eine neue Epoche in der Geschichte, ein neues Denken, vielleicht für ein neues, anderes oder sogar besseres Leben. Für ein neues Lebensgefühl? Europa stand fast 60 Jahre nach dem Ende des 2. Weltkrieges an einem entscheidenden Wendepunkt. Die Einigung war nahe wie nie zuvor. Als ich diese Arbeit bereits fertig geschrieben hatte, standen die entscheidenden Verhandlungen in Brüssel noch bevor. Wie wir nun alle wissen, scheiterten sie an Polen und Spanien. Ob Europa jemals eine eigene Verfassung haben wird oder ob sich die “Kernstaaten” zusammenschließen weiß niemand. Trotz dieser Brisanz möchte ich mich mit einer anderen Thematik auseinandersetzen. die, wenn es schlecht läuft, immer rein theoretisch bleiben wird: die Demokratie in Europa. Europa steht in seinem Inneren vor einer besonders hohen Hürde; das vereinte Europa dem Bürger nahezubringen, ihn an diesem stetigen Prozess teilhaben zu lassen, ihn zu integrieren und zu fordern. Dabei muss die Union Starrheit und Schwerfälligkeit verlieren, sowie im Gegensatz dazu an Transparenz und Effizienz gewinnen. Der wichtigste Punkt aber ist die Einbindung des Bürgers. Er sollte das Gefühl bekommen an diesem Teil der Geschichte mitgewirkt zu haben, einen gewissen Grad an Kontrolle ausüben zu können und somit ein Identitätslevel zu erreichen, welches für eine funktionierende Union geboten ist. Die folgende Arbeit soll sich nun zunächst mit der Entstehung der Verfassung beschäftigen und danach das Problem der demokratischen Legitimation beleuchten. Gerade mich, als Studentin der Rechtswissenschaften, interessiert, inwieweit die Verfassung auf das Volk Europas zurückzuführen ist oder welche Probleme in diesem Zusammenhang aufgetreten sind. Abgerundet werden meine Ausführungen mit einem kurzen Einblick in die Meinungen der Bürger und Bürgerinnen zu diesem Thema. Ich werde für die Vereinfachung den Begriff “Europäische Verfassung” verwenden.

Having won a two-third majority in Parliament at the 2010 elections, the Hungarian political party Fidesz removed many of the institutional obstacles of exerting power. Just like the party, the state itself was placed under the control of a single individual, who since then has applied the techniques used within his party to enforce submission and obedience onto society as a whole. In a new approach the author characterizes the system as the ?organized over-world?, the ?state employing mafia methods? and the ?adopted political family', applying these categories not as metaphors but elements of a coherent conceptual framework. The actions of the post-communist mafia state model are closely aligned with the interests of power and wealth concentrated in the hands of a small group of insiders. The development of EU enlargement has raised many thorny issues unanticipated by the framers of the EC Treaty. The major contribution of this important book lies in its analysis of the conceptualization and perception of enlargement from various points of view, focusing on the concerns of stakeholders and the ‘identity’ conflicts and uncertainties incurred by enlargement initiatives. In the course of its presentation, it details the actual pre-accession Europeanization process and its complex history. Among the key elements discussed are the following: the conflict between ‘widening’ and ‘deepening’ and the effect on EU institutional reform; institutional requirements on candidate countries; pre-accession criteria and negotiations; administrative capacity, judicial capacity, and legal approximation in accession states; capacity of the EU to absorb new Member States; and EC law as part of European identity. Also covered are specific historical details of particular pre-accession negotiations (e.g., Greece, Spain, Portugal, Malta, and Cyprus), the still inconclusive negotiations with Turkey and the Western Balkan states, and political factors involved in the non-accession of Norway, Iceland and Switzerland.
