Auch in der Diktaturforschung wird der Begriff niemals wertneutral eingesetzt. Diese negative Konnotation festigte sich nach den Erfahrungen des Zweiten Weltkrieges und den Schrecken, den diktatorisch geführten Bewegungen des Faschismus und Bolschewismus über Europa und die Welt gebracht hatten. Wie aber wurde die Diktatur von Historikern und Intellektuellen bewertet, denen der Zweite Weltkrieg noch bevor stand, die aber gleichzeitig in einem Europa lebten, in dem zahlreiche Staaten von autokratischen Regimen geführt wurden? Ein Beispiel ist der österreichisch-polnische Historiker Otto Forst de Battaglia (1889-1965), der 1930 einen Sammelband namens Prozess der Diktatur veröffentlichte, in dem er die Diktatur als das beherrschende Problem „unserer politischen Gegenwart“ bezeichnete. Forst-Battaglia machte der Diktatur in einem abschließenden Kapitel gar einen imaginierten Prozess mit dem interessanten Urteil: „Freispruch im Prozess der Diktatur.“ Wie kommt ein Mann, der später als Erasmus seiner Zeit und als wertkonservativer, katholischer Liberaler galt, zu einem solchen, aus heutiger Perspektive bemerkenswerten Ergebnis?

This book provides a comprehensive analysis of social policy in the German Democratic Republic (GDR, 1949-1990), followed by an analysis of the “Social Union”, the transformation of social policy in the process of German unification in 1990. Schmidt’s analysis of the GDR also depicts commonalities and differences between the welfare state in East and West Germany as well as in other East European and Western countries. He concludes that the GDR was unable to cope with the trade-off between ambitious social policy goals and a deteriorating economic performance. Ritter embeds his analysis of the Social Union in a general study of German unification, its international circumstances and its domestic repercussions (1989-1994). He argues that social policy played a pivotal role in German unification, and that there was no alternative to extending the West German welfare state to the East. At the end of World War II the Allies faced a threefold challenge: how to punish perpetrators of appalling crimes for which the categories of 'genocide' and 'crimes against humanity' had to be coined; how to explain that these had been committed by Germany, of all nations; and how to reform Germans. The Allied answer to this conundrum was the application of historical reasoning to legal procedure. In the thirteen Nuremberg trials held between 1945 and 1949, and in corresponding cases elsewhere, a concerted effort was made to punish key perpetrators while at the same time providing a complex analysis of the Nazi state and German history. Building on a long debate about Germany's divergence from a presumed Western path of development, Allied prosecutors sketched a historical trajectory which had led Germany to betray the Western model. Historical reasoning both accounted for the moral breakdown of a 'civilised' nation and rendered plausible arguments that this had indeed been a collective failure rather than one of a small criminal clique. The prosecutors therefore carefully laid out how institutions such as private enterprise, academic science, the military, or bureaucracy, which looked ostensibly similar to their opposite numbers in the Allied nations, had been corrupted in Germany even before Hitler's rise to power. While the argument, depending on individual protagonists, subject matters, and contexts, met with uneven success in court, it offered a final twist which was of obvious appeal in the Cold War to come: if Germany had lost its way, it could still be brought back into the Western fold. The first comprehensive study of the Nuremberg trials, The Betrayal thus also explores how history underpins transitional trials as we encounter them in today's courtrooms from Arusha to The Hague.
