Muita coisa mudou desde a edição da Lei Anticorrupção do Brasil (Lei 12.846/13), de forma que, em 10 anos de sua vigência, diversas empresas já implantaram programas de Compliance em suas operações, tendo em vista que o atual ambiente de negócios não permite que não haja compromisso com a ética entre os players do mercado. Não bastasse isso, o covid-19 acelerou a digitalização das atividades corporativas, detectando-se novos riscos, principalmente os cibernéticos, que passaram a ocupar lugar relevante nas prioridades do Compliance das empresas. Nesse contexto, o programa de Compliance já não pode mais ser gerido da mesma forma, considerando-se as novas necessidades corporativas de mitigação de riscos, o que inclui os riscos criminais digitais, que colocam as empresas como alvo do cybercrime. Logo, os novos red flags cyber passaram a ser mitigados com tecnologia para sua melhor gestão, como a AI, MDM, analytics e etc., que agora fazem toda a diferença no desempenho no Compliance das empresas. No entanto, o uso de tais tecnologias acarreta novos riscos para suas atividades, o que igualmente deve ser monitorado no programa de Compliance e constitui o objeto do presente estudo.
