Gründe dafür sind, dass u.a. die Bedeutung der Religion in unserer Gesellschaft abnimmt. So ist die Zahl der konfessi-onslosen Einwohner bzw. derer, die weder der evangelischen, noch der römisch-katholischen Religion zugehören zwischen 1990 und 2008 um 11,6% gestiegen. Die Seminararbeit befasst sich vor diesem Hintergrund insbesondere mit der Frage, was das Direktionsrecht des Arbeitgebers im Einzelnen bedeutet und wie weit das Direktionsrecht zur Durchsetzung von Neutralitätsgrundsätzen reicht. Darüber hinaus wird sich dabei mit aktueller Rechtsprechung des BVerfG sowie des EuGH auseinandergesetzt und anhand dessen geprüft, welche Voraussetzungen und Grenzen bei dem Eingriff in die Religionsfreiheit als Grundrecht gelten.

The Emancipation of Europe's Muslims traces how governments across Western Europe have responded to the growing presence of Muslim immigrants in their countries over the past fifty years. Drawing on hundreds of in-depth interviews with government officials and religious leaders in France, Germany, Italy, the Netherlands, the United Kingdom, Morocco, and Turkey, Jonathan Laurence challenges the widespread notion that Europe’s Muslim minorities represent a threat to liberal democracy. He documents how European governments in the 1970s and 1980s excluded Islam from domestic institutions, instead inviting foreign powers like Saudi Arabia, Algeria, and Turkey to oversee the practice of Islam among immigrants in European host societies. But since the 1990s, amid rising integration problems and fears about terrorism, governments have aggressively stepped up efforts to reach out to their Muslim communities and incorporate them into the institutional, political, and cultural fabrics of European democracy. The Emancipation of Europe’s Muslims places these efforts--particularly the government-led creation of Islamic councils--within a broader theoretical context and gleans insights from government interactions with groups such as trade unions and Jewish communities at previous critical junctures in European state-building. By examining how state-mosque relations in Europe are linked to the ongoing struggle for religious and political authority in the Muslim-majority world, Laurence sheds light on the geopolitical implications of a religious minority’s transition from outsiders to citizens. Predictive Sentencing addresses the role of risk assessment in contemporary sentencing practices. Predictive sentencing has become so deeply ingrained in Western criminal justice decision-making that despite early ethical discussions about selective incapacitation, it currently attracts little critique. Nor has it been subjected to a thorough normative and empirical scrutiny. This is problematic since much current policy and practice concerning risk predictions is inconsistent with mainstream theories of punishment. Moreover, predictive sentencing exacerbates discrimination and disparity in sentencing. Although structured risk assessments may have replaced 'gut feelings', and have now been systematically implemented in Western justice systems, the fundamental issues and questions that surround the use of risk assessment instruments at sentencing remain unresolved. This volume critically evaluates these issues and will be of great interest to scholars of criminal justice and criminology.
