The 1948 Declaration of Human Rights demanded a collaboration among exponents from around the world. Embodying many different cultural perspectives, it was driven by a like-minded belief in the importance of finding common principles that would be essential for the very survival of civilization. Although an arduous and extensive process, the result was a much sought-after and collective endeavor that would be referenced for decades to come. Motivated by the seventieth anniversary of the 1948 Universal Declaration of Human Rights and enriched by the contributions of eminent scholars, this volume aims to be a reflection on human rights and their universality. The underlying question is whether or not, after seventy years, this document can be considered universal, or better yet, how to define the concept of “universality.” We live in an age in which this notion seems to be guided not so much by the values that the subject intrinsically perceives as good, but rather by the demands of the subject. Universality is thus no longer deduced by something that is objectively given, within the shared praxis. Conversely, what seems to have to be universal is what we want to be valid for everyone. A settant'anni dalla più celebre ed universale Dichiarazione dei Diritti dell'Uomo, continua ad essere urgente la necessità di semantizzarli alla luce di un'antropologia filosofica. Già, perché è proprio di umanità che parliamo quando chiamiamo in causa questi diritti, che non per essere arrivati alla positivizzazione solamente in epoca così tarda possono considerarsi un'invenzione moderna o postmoderna. L'approccio ontofenomenologico adottato in questo studio legittima la persuasione che di una struttura del giuridico si tratti, e non di una sua contingenza come orizzonte definitivo del discorso giuridico. Se è l'umanità degli uomini la cifra specifica di questi diritti, è su di essa che occorre filosoficamente interrogarsi e riflettere, anche proprio allo scopo di comprendere meglio la loro portata, i possibili contenuti e limiti, la genealogia come le applicazioni, e quindi il fondamento della loro pretesa di giustiziabilità, così audace e così spesso frustrata.

Il cosmopolitismo e la dottrina dei diritti umani risalgono a tradizioni politiche teoriche sostanzialmente diverse, ma condividono un fondamentale tratto comune: il costante riferimento a orientamenti universalistici di valore fatti su misura per tutelare il valore dell’individuo. I diritti umani rappresentano la bussola di orientamento del cosmopolitismo, nel senso che sono giusti o giuridicamente validi su un piano etico-razionale per tutti e in generale e perciò risultano applicabili in tutto il mondo. A condizione, però, di essere rivendicati “dal basso” e di non essere fatti cadere paternalisticamente dall’alto sulla testa dei loro beneficiari. Solo un cosmopolitismo democratico, cioè, è compatibile con il pluralismo morale ed è realisticamente in grado di promuovere il diritto di tutti gli individui di scegliere la vita che essi ritengono opportuno condurre.
