Over the past several years, while visible protests against the World Bank and the I.M.F. made front-page news, there has been a growing field of scholarship that looks at the role of globalization for national and international state identities. The first truism of globalization -- that we live in an increasingly interconnected world, one in which it is impossible to separate the fate of one nation from that of the others -- was dramatically illustrated on September 11, 2001, when the seemingly distant effects of a civil war in Afghanistan so murderously interrupted life in the United States. Implicating Empire is the first book to look at four crucial dimensions of globalization: first, its role vis-a-vis the current war; second, the impact of globalization on domestic U.S. policy; third, how globalization will necessarily alter national security, both in its definition as well as how it is pursued, and, finally, the future of globalization. Including original essays by Stanley Aronowitz, Ahmed Rashid, Tariq Ali, Manning Marable, Michael Hardt, and Ellen Willis, among others, Implicating Empire will set the agenda for how globalization is debated -- and resisted -- in the future.

Redefining Sovereignty written by Michael Bothe and has been published by Brill Nijhoff this book supported file pdf, txt, epub, kindle and other format this book has been release on 2005 with Law categories.

With considerable insight and analysis, the editors and contributors to the book--the world's leading ethicists, political scientists and international lawyers--investigate the use of force since the end of the Cold War and, simultaneously, what changes have or should occur with respect to sovereignty and the law in the 21st century. Redefining Sovereignty has resulted from three groundbreaking workshops on international law and the use of force: the first was held in Rome soon after NATO's 1999 intervention in Kosovo; the second took place in Frankfurt after the U.S.-led invasion of Afghanistan; and the third occurred in Columbus, Ohio after the U.S.-led invasion of Iraq. Together, these and other uses of armed force since the end of the Cold War have raised new and challenging questions for the international law and policy on the regulation of armed conflict. These questions are explored in the thoughtful text, including: With the end of superpower rivalry have these uses of force had a particular impact on the state system? Have they, for example, affected the concept of state sovereignty? Have they affected the legal regime on the use of force? By the time of the Iraq invasion in March 2003, had some uses of force long-considered prohibited by the principle of non-intervention become lawful? Did the use of force to protect human rights, to respond to terrorism, for arms control or to preempt future threats become lawful or if not lawful, somehow otherwise legitimate? Published under the Transnational Publishers imprint.

While environmentalists insist that lower rates of consumption of natural resources are essential for a sustainable future, many economists dismiss the notion that resource limits act to constrain modern, creative societies. The conflict between these views tinges political debate at all levels and hinders our ability to plan for the future. Supply-Side Sustainability offers a fresh approach to this dilemma by integrating ecological and social science approaches in an interdisciplinary treatment of sustainability. Written by two ecologists and an anthropologist, this book discusses organisms, landscapes, populations, communities, biomes, the biosphere, ecosystems and energy flows, as well as patterns of sustainability and collapse in human societies, from hunter-gatherer groups to empires to today's industrial world. These diverse topics are integrated within a new framework that translates the authors' advances in hierarchy and complexity theory into a form useful to professionals in science, government, and business. The result is a much-needed blueprint for a cost-effective management regime, one that makes problem-solving efforts themselves sustainable over time. The authors demonstrate that long-term, cost-effective resource management can be achieved by managing the contexts of productive systems, rather than by managing the commodities that natural systems produce.

Soft Law In European Community Law written by Linda Senden and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2004-09-30 with Law categories.

This book offers the first systematic investigation of the phenomenon of soft law within the framework of the EC (the first pillar of the EU),and its use by the European Commission and Council of Ministers. It focusses upon how soft law fits into the Community legal system, and how it is used, and, in particular, how it relates to Community legislation. Differentiation of the Community instruments, including the instruments of soft law, is often thought to enhance the effectiveness, legitimacy and transparency of the Community. This book asks whether soft law indeed provides a satisfactory alternative to legislation from this perspective and, if so, in what cases and under what conditions. Furthermore, the author asks to what extent the use of soft law implies good governance, and throws fresh light on this very heterogenous phenomenon, by looking at frequently used instruments in many different areas of Community law, such as competition law, state aid, environment, social policy etc., in the process identifying their different characteristics, aims, functions and legal effects. What emerges is that the conditions under which soft law is used may be problematic in relation to increasing the legitimacy, effectiveness and transparency of Community action. This is a work which will interest legal practitioners confronted with the use of soft law and the question of its possible legal effect in an increasing number of sectors and academics interested in the vexed question of how the increased use of soft law can be justified in a Community legal order built upon the rule of law. It is also critical of developments taking place within the framework of the European Convention and the proposed European Constitution, and goes beyond the immediate problems of soft law to touch upon issues such as competence, legal protection, division of powers between the EC and the Member States, institutional balance, lawmaking by the Community Courts, the scope of Community legal principles and the influence of soft law on the progressive development of both Community and national law.
