Esta obra estuda o discurso de ódio, por meio da análise do modo como o jurista e a Jurisdição Constitucional tratam do tema. Apresenta uma profunda e minuciosa pesquisa nos precedentes firmados nos Estado Unidos e na Alemanha, de modo a indicar o caráter histórico, político e cultural que envolve a tomada de posição em relação ao discurso de ódio. Desmonta se, assim, a ideia de que exista um sistema americano, em contraposição ao sistema alemão, de liberdade de expressão, bem como um suposto conflito entre liberdade de expressão e igualdade. Aponta a insuficiência da adoção de teorias constitucionais simplificadoras, que estabelecem um distanciamento da linguagem do Direito em relação à complexidade do problema do discurso do ódio. Da mesma forma, o texto expõe o posicionamento doutrinário nacional, bem como a jurisprudência do Supremo Tribunal Federal que tratam do discurso do ódio, que refletem a importação acrítica das teorias constitucionais produzidas naqueles países. A utilização da doutrina do livre mercado de ideias, da ponderação de princípios e do Direito como Integridade, de Ronald Dworkin, impede a problematização da controvérsia, afastando do debate elementos cruciais para a sua solução. Essas concepções geram as mais variadas incongruências jurídicas, posicionamentos díspares baseados na mesma teoria constitucional, metodologias abstratas para solução de problemas concretos, distanciamento e contradições. Dada essa realidade, observa-se que a análise do problema do discurso do ódio exige um novo comportamento do jurista, a partir da adoção de um novo vocabulário. Com o auxílio do enfoque proposto pelo pragmatismo, escorado principalmente nas ideias de Richard Rorty, Stanley Fish e Richard Posner, bem como nas concepções da Critical Race Theory, defende-se que a abordagem de controvérsias relacionadas a direitos humanos atente para as narrativas de dor e sofrimento dos interessados, bem como para as consequências das decisões a serem tomadas, deixando-se de lado o vocabulário da teoria dos direitos fundamentais. O livro apresenta, ainda, um apêndice especial, no qual se analisa a recente posição do Supremo Tribunal Federal acerca da criminalização do discurso homotransfóbico. Os fundamentos utilizados pela Corte no julgamento da ADO n.o 26 são profundamente estudados, a partir das premissas teóricas defendidas no curso da obra.
