Essay from the year 2019 in the subject Politics - International Politics - General and Theories, grade: C, University of Catania (Department of Political and Social Sciences), language: English, abstract: Nature bestowed right to freedom on human beings in the state of nature, according to the naturalist. The right to freedom possessed by individuals in the state of nature allowed them access to the land. Therefore, possession of property emanates from the ability of individuals to work the land, according to John Locke. As a result, individuals had unequal possession and right to property in the state of nature. The departure from the state of nature to the political state means that human beings moved with their rights of ownership to property. However, the land that was free for all to work upon in order to acquire right of ownership is being controlled by the state in order to prevent unequal distribution of resources and promote redistribution of common good amongst the people. And also, to effectively manage the scarce resources in the civil state that form the basis of property ownership in the political state. Therefore, individuals in the political state are duty bound to the state authority in terms of obligation and respect for the state laws. On the other hand, the state is expected to protect and guarantee the rights of the people. In the case of breach of the trust reposed in the state, the essence of departing the state of nature has been defeated and consequently, the state has lost its legitimacy. Therefore, right to property commands obligation to the state. This essay aims at discussing Locke's political thought on 'property and obligation' as demonstrated in Schochet's work on 'guards and fences.'

This volume guides the reader through a detailed examination of the text to an understanding of Locke’s political ideas in relation to his writings on philosophy, education, religion and economics and the influence these ideas had upon eighteenth-century political theorists. The author shows how Locke carefully constructed his political perspective as a defence of the principles of natural rights, constitutional government and popular resistance. He offers an original interpretation of the Two Treatises..., emphasizing the specific ways in which Locke’s political purposes in writing the work influence his discussion of such concepts as the state of nature, property, consent and tyranny. The author discusses the historical and biographical context of the work and demonstrates how eighteenth century political thinkers developed or rejected aspects of Locke’s political theory and summarizes important recent studies of Locke’s work.

John Locke's political theory has been the subject of many detailed treatments by philosophers and political scientists. But The Lockean Theory of Rights is the first systematic, full-length study of Locke's theory of rights and of its potential for making genuine contributions to contemporary debates about rights and their place in political philosophy. Given that the rights of persons are the central moral concept at work in Locke's and Lockean political philosophy, such a study is long overdue.

John Locke's theory of property is perhaps the most distinctive and the most influential aspect of his political theory. In this book James Tully uses an hermeneutical and analytical approach to offer a revolutionary revision of early modern theories of property, focusing particularly on that of Locke. Setting his analysis within the intellectual context of the seventeenth century, Professor Tully overturns the standard interpretations of Locke's theory, showing that it is not a justification of private property. Instead he shows it to be a theory of individual use rights within a framework of inclusive claim rights. He links Locke's conception of rights not merely to his ethical theory, but to the central arguments of his epistemology, and illuminates the way in which Locke's theory is tied to his metaphysical views of God and man, his theory of revolution and his account of a legitimate polity.

The Limits Of Lockean Rights In Property written by Gopal Sreenivasan and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 1995-09-14 with Philosophy categories.

This book discusses Locke's theory of property from both a critical and an interpretative standpoint. The author first develops a comprehensive interpretation of Locke's argument for the legitimacy of private property, and then examines the extent to which the argument is really serviceable in defense of that institution. He contends that a purified version of Locke's argument--one that adheres consistently to the logic of Locke's text while excluding considerations extraneous to his logic--actually does establish the legitimacy of a form of private property. This version, which is both defensible in contemporary, secular terms and is, essentially, egalitarian, should provoke a reassessment of the nature of Locke's relevance to contemporary discussions of distributive justice.
