The basis of the UK Civil Service was set out 150 years ago in the Northcote-Trevelyan report ('The organisation of the permanent Civil Service', Parliamentary Papers, Vol. XXVII, 1854). The management of the Service has evolved over this time through a non-statutory approach, and the creation of a statutory basis to underpin the role, governance and values of the Civil Service would be a major constitutional reform. This consultation paper seeks comments on whether legislation is a necessary and desirable step to take in support of the core service values of integrity, impartiality and objectivity, in the light of the modern challenges it faces in the 21st century. It contains the text of the Government's draft Civil Service Bill, which would cover staff in the Home Civil Service and the Diplomatic Service, and other government agencies including the Forestry Commission, ACAS, HSE and OFSTED; as well as the devolved administrations in Scotland and Wales. The provisions exclude civil servants working in the Secret Intelligence Service and Security Service agencies, and the Northern Ireland Civil Service. The draft Bill contains proposals to establish a Civil Service Commission as an independent statutory body to uphold the principle of selection on merit through fair and open competition, although it provides for the continuing exemption of special advisers from this requirement. It seeks to clarify what special advisers can and cannot do, by redefining their general function as 'assisting' Ministers, and determining that special advisers cannot authorise expenditure, exercise line management supervision over permanent civil servants, or discharge statutory powers. Responses to the consultation paper should be received by 28 February 2005.

This consultation paper sets out the Government's proposals for reform of the law on defamation, aiming to achieve balance between protection of freedom of speech and the protection of reputation. The Government wants to ensure that the threat of libel proceedings is not used to frustrate robust scientific and academic debate, or to impede responsible investigative journalism and the valuable work undertaken by nongovernmental organisations. Issues included in the draft Bill are as follows: a new requirement that a statement must have caused substantial harm in order for it to be defamatory; a new statutory defence of responsible publication on matters of public interest; a statutory defence of truth (replacing the current common law defence of justification); a statutory defence of honest opinion (replacing the current common law defence of fair/honest comment); provisions updating and extending the circumstances in which the defences of absolute and qualified privilege are available; introduction of a single publication rule to prevent an action being brought in relation to publication of the same material by the same publisher after a one year limitation period has passed; action to address libel tourism by ensuring a court will not accept jurisdiction unless satisfied that England and Wales is clearly the most appropriate place to bring an action against someone who is not domiciled in the UK or an EU Member State; removal of the presumption in favour of jury trial, so that the judge would have a discretion to order jury trial where it is in the interests of justice.

This report examines the operational and constitutional relationship between government ministers and civil servants, including the issues of ministerial and civil service accountability, the role of ministers in making appointments and the position of special advisers, and whether it is time to give the civil service a proper constitutional footing. It considers what is meant by politicisation, whether politicisation is an entirely negative phenomenon, and, if it is not, what kinds of politicisation would be appropriate in the UK. The Committee notes that the UK civil service in held in high regard, both at home and abroad, and that it is essential that the governing relationship is kept in good repair for effective government and proper accountability. Recent difficulties have highlighted long-standing concerns about the way in which responsibility and accountability are divided in the UK political system, and the report proposes a number of steps aimed at contributing to its good working in combining an independent civil service with political accountability for its operation. Amongst the 27 conclusions and recommendations made, the report calls for a new "public service bargain" underpinned by a governance code which seeks to clarify the respective responsibilities and expectations of ministers and civil servants, including the need for a Civil Service Act to clarify the constitutional position of the civil service.

Contingencies Resilience And Legal Constitutionalism written by Clive Walker and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-10-02 with Law categories.

Contingency planning and resilience are of prime importance to the late modern risk society, with implications for law and for governance arrangements. Our risk society continues to seek ever more complex and detailed risk mitigation responses by law, including the UK’s Civil Contingencies Act 2004 and the US Homeland Security Act 2002, which respond to counter-terrorism, natural catastrophes, and other risks. This book seeks to analyse and criticise the legal developments in contingencies and resilience on a comparative basis, which engages with not only law and constitutionalism but also political theory and policy, including relations between public and private, national and local, and civil and military. Two transcending themes are of interest. One is institutional or structural – what bodies and power relations should we establish in a late modern world where Critical National Infrastructure is mainly held in private hands? The second is dynamic and concerns the grant of powers and arrangements for live responses. Both aspects are subjected to a strong critical stance based in 'constitutionalism', which demands state legitimacy even in extreme situations by the observance of legality, effectiveness, accountability, and individual rights. This book was originally published as a special issue of the International Journal of Human Rights.
