Le développement du média Internet dans la publicité constitue une évolution technologique majeure dans le domaine de la communication. Internet correspond du point de vue technique à une transformation des formes et des contenus de la communication commerciale, et du point de vue économique à un bouleversement du marché de la publicité puisque la publicité électronique concerne à la fois les écrits, les images, les sons et les films. Cette place considérable de la publicité électronique pose la question de l'adaptation du droit. Internet transforme le cadre juridique de la publicité puisque le message transmis n'est plus passif mais interactif. De ce fait, la publicité informative devient agressive dans la mesure où elle peut porter atteinte aux droits fondamentaux de protection des données personnelles et de protection du consommateur. Il est donc apparu nécessaire de réglementer le message publicitaire sur Internet à la fois dans la forme et dans le contenu. Tel est le but, principalement, de la loi pour la confiance en l'économie numérique du 21 juin 2004, qui transpose le droit européen sur l'économie numérique en droit français et qui concerne directement l'utilisation et le contrôle de la publicité sur Internet. Cependant, l'analyse du droit de la publicité sur Internet conduit à montrer que le droit actuel et son évolution récente sont insuffisamment adaptés pour résoudre les problèmes de la protection de l'utilisateur d'Internet face à la multiplication des formes et des contenus de messages publicitaires non désirés d'autant plus qu'il existe une limite importante du fait que le support publicitaire Internet est sans frontières et de ce fait peut échapper au cadre national ou régional, notamment européen, du droit. Il en résulte que l'étude du droit de la publicité sur Internet peut être considérée comme un des exemples priviliégiés de l'adaptation des outils juridiques face aux défis résultant du développement des nouvelles technologies de communication et pose les problèmes des nouvelles régulations face au contexte de mondialisation.
