L'Europe est en marche. Plus ou moins rapidement, mais inéluctablement, des changements vont intervenir, tant dans le comportement des hommes, que dans la marche des institutions. Le secteur santé (et plus particulièrement les hôpitaux), ne restera pas en dehors des mutations à venir. Qui plus est, l'importance et la primauté qui leur sont désormais reconnues, l'accès au monde entièrement nouveau que génère le développement des techniques médicales, le passage du concept d'usager à celui de consommateur, vont amplifier encore les évolutions à mettre en œuvre. Les institutions internationales, les différents États européens, recherchent les moyens d'adaptation aux réalités nouvelles, tant en termes de droit qu'en termes d'éthique, plus que jamais nécessaires au niveau des comportements collectifs et individuels. Une attention portée au-delà de nos frontières, un examen attentif des projets à l'étude, voire un travail en synergie, devraient faciliter et accélérer - au niveau des services de santé - l'émergence de nouveaux droits des personnes. C'est pourquoi, l'Institut de recherches hospitalières, avec l'appui de nombreuses associations et le concours de très hautes personnalités, dans un colloque que veut bien accueillir le Sénat, entend apporter messages et enseignements à tous les acteurs de santé, préoccupés et en charge de l'avenir.

Cette thèse analyse la protection de la santé dans l'ordre juridique de l'Union européenne. Elle sera divisée en trois parties. Dans la première on aborde la compétence de l'Union en matière de santé en soulignant le rôle des articles 168 et 114 TFUE et des principes de subsidiarité et solidarité. Dans la deuxième, consacré au marché intérieur, on explore la libre circulation des médecines, le droit d'établissement des personnes physiques et morales engagé dans les activités économiques liées à la santé et finalement la mobilité des patients comme forme spécifique de la libre prestation de services. Dans la troisième, on s'interroge si la santé est un droit fondamental selon l'art. 35 de la Charte des droits fondamentaux de l'Union Européenne en utilisant les trois obligations classiques -tirées du droit international- de protéger, respecter et accomplir ; enfin, on examine le principe de non-discrimination en relation à l'accès aux soins médicaux et le consentement éclairé.

The Council of Europe is convinced of the need to improve access to social rights as a key means of combating poverty and social exclusion and in promoting social cohesion. This report analyses the obstacles impeding access to different social rights within and across a range of fields.
