Le droit à l’autodétermination est-il synonyme de droit à la sécession? Le Québec peut-il unilatéralement faire sécession du Canada? Quelles pourraient être les modalités d’un référendum sur l’indépendance? Le droit international a-t-il préséance sur le droit interne? Vingt ans après notre dernière aventure référendaire, quel est l’état des lieux en matière de droit à l’indépendance? En 1998, était rendue l’une des décisions les plus marquantes de la Cour suprême du Canada: le Renvoi relatif à la sécession du Québec. À l’époque, cette décision déclencha une véritable controverse, mais une chose est certaine: le Renvoi de 1998 demeure pertinent, d’autant qu’on en trouve dorénavant de nombreux échos sur le plan international. En effet, douze ans plus tard, la Cour internationale de justice de La Haye s’est référée au Renvoi canadien dans le cadre de son avis consultatif sur la déclaration d’indépendance du Kosovo. Aussi, en septembre 2014, le peuple écossais s’est prononcé sur son avenir à la suite d'un accord négocié entre Londres et Édimbourg qui, non seulement s’inspirait de l'expérience québécoise, mais pourra à son tour devenir un exemple utile au pays. Cela dit, plus encore que son influence à l’étranger, c’est la perspective nationale de cette décision historique qui est la motivation première de cet essai, et ce, pour favoriser une meilleure compréhension des motifs de la Cour et des enseignements qui en découlent. Nous invitons ceux et celles qui seront appelés à analyser ces enjeux dans le futur à développer leur propre compréhension de l’Avis de 1998, au-delà des nombreux discours tenus depuis plus de quinze ans par les camps opposés, souverainiste et fédéraliste.
