The former show where the law may be found in one of the most recent compilations of the State statutes or in session laws issued subsequently to the publication of the compiled statutes Such references are placed in a separate line following the sections to which they refer. Each general reference covers all sections included between it and the general refer ence just preceding. Excerpt from Drug Legislation in the United States: Revised to July 15, 1908 Because of the general interest manifest in the subject of drug legislation and the repeated requests which are coming to the Bureau of Chemistry for information on this subject from Federal and State legislators, physicians, druggists, and others, it was considered desir able to collect into bulletin form for ready reference all existing laws in force which have been enacted for the purpose of minimizing the sale of adulterated and deteriorated drugs and for safeguarding the public health by restricting the sale of poisonous and habit-forming drugs. These laws were collected and issued in 1906 as Bureau of Chemistry Bulletin No. 98. Since its issuance much new legislation along these lines has been enacted, necessitating a revision of this bulletin. In a few cases it has been difficult to determine whether or not some of the older legislation has been repealed by implication or otherwise, and for this reason there may be included legislation which in time will be declared null and void by the courts. Excerpt from State "Pure Drug" Laws: Enacted Since the Passage of the National Food and Drug Act, June 30th, 1906, With a Reprint of Said Act as Amended Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That it shall be unlawful for any person to manufacture within any territory or the District of Columbia any article of food or drug which is adulterated or misbranded, within the mean ing of this act; and any person who shall violate any of the provisions of this section shall be guilty of a misdemeanor, and for each offense shall, upon conviction thereof, be fined not to exceed five hundred dollars or shall be sentenced to one year's imprisonment, or both such fine and imprisonment, in the discretion of the court, and for each subsequent offense and conviction thereof shall be fined not less than one thou sand dollars or sentenced to one year's imprisonment, or both such fine and imprisonment, in the discretion of the court. Excerpt from The Food and Drugs Act, June 30, 1906: A Study With Text of the Act, Annotated, the Rules and Regulations for the Enforcement of the Act, Food Inspection Decisions and Official Food Standards The sentiment back of the Food and Drugs Act is well understood. Every one will agree that, so far as it can be done by legislation, the laws should protect the public from being deceived in the foods which nourish them or in the medicines which are relied on to cure their ills. But to formulate a law which will effectively protect the public without depriving it of freedom to eat what it may choose to 'eat and to take such remedies as it may wish to take, and without serious disturbance of business conditions, and especially to formulate a. Federal law which will do this with out transcending the powers conferred on the Congress by the Constitution, is a matter of great difficulty. It is not surprising that the Food and Drugs Act is in some respects difficult to understand. Some of the questions as to its meaning have been answered by expressions of opinion from the Department of Agriculture. Other questions have not been answered and cannot be answered definitely until the meaning of the Act has been determined by the courts. In the matter here contained I have presented such information bearing upon the Act as can be gathered from the decisions given out by the Department of Agriculture, the published expressions of opinion of officials charged with the enforce ment of the Act, and the views expressed by those who have studied the Act with especial care in the interest of the manufacturers of and dealers in particular lines of food and drug products. Whatever sentiments may be entertained as to what ought to be the law and what ought to be done by law with refer ence to the question of pure foods and pure drugs, the ques tion as to which my clients have wanted information is theiv Preface.
