Februar 2005 wurde die Deutschtürkin Hatun Sürücü von ihrem Bruder Ayhan an einer Bushaltestelle in Berlin erschossen. Die nach traditionellen islamischen Werten und den Sitten und Gebräuchen ihrer ostanatolischen Herkunftsregion erzogene junge Frau lebte seit einiger Zeit getrennt von ihrer Familie, sie hatte das Kopftuch abgelegt, schminkte sich, kleidete sich nach westlichen Maßstäben und hatte bereits einige Beziehungen zu verschiedenen Männern geführt. „Ay. [Ayhan] verachtete H. [Hatun] wegen ihres von ihm als ehrlos empfundenen Lebenswandels. Nach seiner Auffassung verletzte sie damit die „Familienehre, die insbesondere von den Frauen der Familie über ihre sexuelle Integrität verkörpert“ werde. Seiner Meinung nach oblag es den Männern der Familie, die durch das Verhalten eines weiblichen Familienmitglieds vermeintlich verletzte Familienehre wiederherzustellen“. Dieses Beispiel zeigt, dass Tötungen aufgrund eines verletzten Ehrgefühls nicht nur ein Phänomen der Türkei oder anderer vornehmlich islamisch geprägter Länder sind, sondern auch in Deutschland und in anderen europäischen Ländern vorkommen. Im Rahmen der vorliegenden Arbeit soll untersucht werden, ob der Ehrenmord ein spezifisch islamisches Problem oder möglicherweise gar kein religiöses, sondern ein kulturelles Phänomen ist. Weiterhin soll untersucht werden, was für ein Islamverständnis Familien, in denen Ehrenmorde geschehen, haben und was der Koran zum Thema Töten und zur Züchtigung ungehorsamer Frauen sagt. Ferner soll erörtert werden, ob die Männer, die Ehrenmorde ausführen, ebenfalls Opfer, nämlich Opfer ihrer eigenen Kultur, sind. Ein weiterer wichtiger Aspekt dieser Arbeit ist der rechtliche Umgang mit Ehrenmördern. Es wird untersucht, wie die Rechtslage in Deutschland und in der Türkei aussieht und wie mit Ehrenmördern und ihren Familien, die in der Regel Mitwisser, manchmal sogar Mittäter, sind, umgegangen wird. Bevor mögliche Antworten auf diese Fragen erörtert werden, wird die Arbeit mit zwei Definitionen zum deutschen und türkischen Ehrbegriff eingeleitet. Für ein besseres Verständnis der Hintergründe werden im darauf folgenden Kapitel mögliche Ursachen für Tötungen aus Gründen der Ehre und der Tradition erörtert. Die Strafrechtsdogmatik steht den damit zusammenhangenden Fragen bislang hilflos gegenuber. Die Autorin mit turkischem Hintergrund hat sich die Aufgabe gestellt, das Phanomen des Ehrenmordes naher zu beleuchten. Dabei begibt sie sich in weiten Strecken auf wissenschaftliches Neuland. Untersucht werden unter anderem die Moglichkeiten der Berucksichtigung soziokultureller Motive im Strafrecht. Welche Einbruchsstellen existieren im Strafgesetzbuch? Honour killing is considered the worst form of domestic violence against human beings, particularly against women. It is clear that societies across the world – through their laws and their courts – continue to countenance legal defences which overwhelmingly benefit males committing violence against females. Despite the statistics that honour killings are being reported from all over the world, the greatest number of shocking reports of honour killings come from Muslim countries. Unfortunately, Pakistan is among those countries where women are facing various forms of violence in the name of religion, customs and traditions, and cases of honour killing are regularly reported there. It is imperative to understand and see killings in the name of honour from the perspective of those who have been directly affected by the socio-religious cultural norms which condone them.
